Reaction of the Agency for the Prevention of Corruption to the text "Waiting for 'white smoke' from the ASK Council", authored by Ana Đurnić, Vijesti 3.6.2020/XNUMX/XNUMX.

Regarding the allegations in the daily newspaper "Vijesti" on June 3, 2020, on page 19, within the text entitled "Waiting for white smoke from the ASK Council", we are submitting a response with the aim of fully and accurately informing the public. Considering that the allegations in question may influence the creation of a wrong perception of the public about the work of this body, in the interest of objectively informing the public, the Agency reminds that the legally obliged person, member of the Senate of the SAI Zoran Jelić, submitted to this body within the legal deadline the Report on the increase of assets for 12.935,17 euros, which he later reported in the regular annual report on income and assets submitted in March of this year, the information about which is publicly available on the Agency's website.

The Agency for the Prevention of Corruption carried out the control of both submitted reports of the legal obligee, and through comparison with the registers of other institutions, established that the appointed person had indeed achieved the reported income, and also noted that he had submitted to the Agency the documentation justifying the basis for obtaining it.

Furthermore, the non-submission to the Institute of alternative documents from the subject of the verification of the report of the legal obligor and the control of the basis of the acquisition of the realized income is conditioned by the legal obligation that the procedure of verification of the Report is not available to the public, which has also been confirmed several times in the second-level administrative and legal practice in similar cases, and by no means in the arbitrariness of the Agency . The Agency also points out that this body responded within the legal deadline to the initiative of the Institute of Alternatives to initiate a procedure to determine the violation of the law by the named legal obligee, and that it delivered the decision (solution) to the obligee within the deadline.

In this regard, the Agency points out that in the administrative matter in question, the officials of this body carried out all the prescribed actions and controls, in accordance with the currently valid legal provisions.

In the end, regardless of who will be the next director of the Agency, this body will act in the same way if the provisions of the Law on Prevention of Corruption are strictly applied in the part of controlling the income and property of public officials.

Savo Milašinović, Acting Director of the Agency for the Prevention of Corruption
