It's Easter, I know that it's not very appropriate to greet those who are celebrating with sloppy legal language, but I'm not alive to not write at least a summary of the long-awaited decision of the highest court instance:
- The Constitutional Court rejected the proposal to establish the unconstitutionality of the Basic Treaty.
The decision was made by the majority of votes, with dissenting opinions of two judges, Dragana Đuranović and Budimir Šćepanović.
The court rejected the proposal to determine the unconstitutionality and illegality of paragraph 3 of the Preamble, as well as of Article 2 para. 1 and 4, Article 6 para. 3, article 7 paragraph 4 and 6 article 8, article 10 paragraph. 2, Article 12 para. 1. and the Basic Agreement from paragraph I of the sentence of this Decision.
Initiatives to initiate the procedure for evaluating the constitutionality and legality of the Basic Agreement from paragraph I of the sentence, as well as initiatives to initiate the procedure for evaluating the constitutionality and legality of paragraphs 1, 2, 4, 5 and 6 of the Preamble, as well as Article 2 paragraph 1 and 2, Article 3, Article 5, Article 6 paragraph 2, Article 7 paragraph 3 and 4, Article 11, Article 12 of the Basic Agreement from paragraph I of the sentence of the Decision.
For those who celebrated the overthrow of Dritan Abazović two years ago, on Preobraženje, due to the signing of the Basic Agreement, the Constitutional Court gave a thorough explanation...

So, what are we going to do now?
Nothing now, but two years ago we could...
So that we don't lose them, falling for the deception of the DPS and its affiliated parties, when we have already lost the previous thirty to the same mantra.
Only the national omen was variable, from the Ustasha attack in 1991 to the Chetnik high treason in 2022...
And do I trust the judges of the Constitutional Court only on the basis that they received broad support in the parliament from an otherwise non-unified party composition?
Not exactly absolutely, but the silence of the former convocation of that court convinced me that this decision was correct.
Which was majority owned by DPS and certainly would not have remained silent if he could have found anything unconstitutional in the Basic Agreement.
Despite this, the already barely formed and unstable minority government was canceled after only 113 days.
With a big risk that the next one cannot be reached even in a year, and even bigger that the next one will be unstable.
And it is...

In addition to the alleged unconstitutionality, the DPS marketing trick was also a hoax that the signing of the contract was prepared "behind the backs of the Montenegrin public"...
The basic agreement is part of the publicly announced Agreement on Parliamentary Support and Political Priorities of the 43rd Government.
Political priorities for the executive power, that's what the fourth chapter of that agreement was called, under which the signature (i) of DPS is written.
It had 14 points, and the fifth read:
- Regulation of contractual relations with religious communities, in accordance with the Constitution and laws of Montenegro!
And who is now working behind who's back?
The government is clearly not to the DPS, but the DPS to the Montenegrin public is clearly - it is.
Everyone who believed their eyes more than DPS could see for themselves. It was written in dozens of announcements, it was seen on a dozen TV channels, it was heard during TV broadcasts of Government sessions.

I myself fell for the third and most blatant prank, this time not only by the DPS but also by the parties and non-governmental organizations connected to it, that the Basic Agreement says what it does not say. Briefly, until I read it.
Of course, the 43rd Government is not giving anything away to the "Church of Serbia" with that contract.
Even if she wanted to, she had no choice because all church property on the territory of Montenegro was already owned by the SPC.
That ownership was, in various stages and under different names, certified in the presence of four independent, sovereign and internationally recognized states - the Kingdom of SHS/Kingdom of Yugoslavia, then DFJ/ FNRJ/ SFRJ, then FRY and - finally - Montenegro...
And not only that, no Montenegrin government - from the Zeta Ban, through the Presidium, the Presidency and the President, to the Assembly, the Executive Council and the Government in all convocations - has ever tried to raise the issue of that ownership.
On the contrary, each tried to register in the name of the SPC what the previous one did not want or was unable to do.
The last gift was the Ostrog Monastery, in 2012 if I remember correctly...

That's how it was from the above-mentioned property angle...
Politically, nothing better, all Montenegrin secular authorities not only accepted but also respected all Serbian patriarchs and metropolitans.
It's true, the communist one was more protocol-oriented and on the home field, but the Depees team also went to the away match for the blessing...
Thanks to the DPS, the Serbian Church is not only the richest but also the most politically powerful social organization in Montenegro today.
In truth, that basic contract was never signed.
It was made orally, around those pits from the Second World War that were dug up and consecrated by the church and the state together in the 1990s.
And he was consistently respected on both sides - with some occasional and occasional hiccups, just enough so that "the hairs don't come to their senses"...
Until in 2016, DPS faced an obvious loss of power.
How he survived, we watched in the trial of the century...
The attempt of a new coup in 2019, this time not on political opponents but on church property, was the beginning of the end of the former regime...
Boomerang returned to DPS, whose blow could not be softened by the belated memory of the original and historical Montenegrin church...
And a slap to the endemic duality of the national Montenegrins who shed crocodile tears over the evil fate of the CPC...
Everyone is racing to see who will baptize the children and intoxicate the parents first, the Metropolitan of the SPC...
