Everything is the same, only he is not there. Duško Marković is here now. This is what Ninoslav Kaluđerović said yesterday in the Basic Court, in the proceedings in which he and seven other people were accused because they peacefully protested because of the bad situation in the country.
Kaluđerović, Marko Milačić, Boban Batrićević, Irena Delja, Danilo Mrvaljević, Miro and Milka Radević and Aljoša Turović are being tried again for failure to comply with the police order to remove them, after the High Court annulled the acquittal decision.
Delje's defense attorney, lawyer Sanja Đurović, assessed that the annulment decision of the High Court was flat and confusing and that the judges of that court approached the evidence selectively.
She added that the defendants' defenses were misinterpreted, because the statements of the High Court that they sat down on the street while the intervention against the hooligans was in progress are completely incorrect.
"The factual situation is interpreted only on the basis of the testimony of members of the police, and even they are misinterpreted, while other statements and evidence are ignored," Đurović pointed out.
The trial came to an end yesterday, after Judge Goran Đuković decided to hold the trial in the absence of Milačić, Radević and Turović, but also to read the statements of the witnesses who did not come yesterday, as well as to read the minutes of the recordings already viewed, against the will of the defense lawyer.
The defense stated that it is necessary to watch the recordings of the disputed event again, in order to establish that the street was closed to traffic.
The judge said there was no need for that.
They are asking the prosecutor to withdraw
Attorney Momčilo Knežević, defending Turović, proposed to the prosecutor to abandon the criminal prosecution of the accused, because he does not see the essence of continuing the proceedings.
Mrvaljević also pointed out that it is clear to a second-year law student that there is no misdemeanor in their behavior, let alone a criminal offense.
Prosecutor Ivan Medojević still stood by his position, not wanting to comment on the lawyer's proposal.
