Special prosecutor Živko Savović filed an indictment against the former president of Nikšić Municipality, Nebojša B. Radojičić, for the criminal offense - extended criminal offense of abuse of official position.

The defendant will be tried by a special panel of the High Court in Podgorica, Judge Suzana Mugoša.

In the indictment, it is written that from January 1 to December 31, 2012, as the mayor of Nikšić, Radojičić exceeded the limits of his official authority and obtained benefits from the companies "Radulović - M3", "Cinema servic", "Kino Akustika", "Ramel", "B Film Montenegro" and "Montenamax" during the renovation of the Scena 213 theater in Nikšić.

It is alleged that the defendant more seriously violated the rights of other potential bidders.

"During the procurement of goods and services for the adaptation and renovation of the theater hall Scena 213 - SNDČEL, the defendant acted contrary to the Law on Public Procurement, without implementing the appropriate public procurement procedure, using uneconomic and irrational public funds, not ensuring equal competition among bidders, benefited the aforementioned legal entities and seriously violated the rights of other interested potential bidders to participate in the public procurement procedure," the indictment reads.

In November 2015, Radojičić was sentenced to four months in prison for abuse of official position, but that sentence was overturned and the case was sent back for retrial.

In the explanation of the rescinded verdict, it is written that Radojičić violated the Law on Public Procurement, because as the president of the Board of Directors of the "Sutjeska" Football Club, he authorized the director Andrija Vujović to sign a contract with the company "Zarubica company" for the construction of the auxiliary stadium.

"By which he obtained a benefit for the engaged contractor and prevented other interested parties from participating in the public procurement procedure".

For the other criminal acts charged against Radojičić, Judge Perović issued an acquittal, which was confirmed by the High Court.

The former president of the Municipality of Nikšić was accused of hiring contractors for the construction of the chapel at the new cemetery in the settlement under Trebjes, the works at the airport in Kapina polje, the decoration of the Day Center and the area around the Music School, using the so-called shopping method or direct contracts, which violated the law.
