"The state prosecutor's appeal contested the verdict on the basis of an erroneously determined factual situation, which, according to the appeal, was the result of the court's erroneous conclusion, which it reached by evaluating the evidence presented... The statements of directly heard witnesses do not even point to the accused as the perpetrator... Properly is the conclusion of the High Court that in this particular case the judgment and the factual situation in relation to Lambulić could not be based on the final judgments of the Provincial Court in Hanover... This is because the proceedings before the judicial authorities in Hanover were not conducted against Lambulić, nor was in those proceedings, any evidence was proposed and presented that would indicate the existence of a criminal offense and his guilt for that offense," the judgment of the Appellate Court reads.

According to the unproven indictment, from November 15 to December 20, 2002, Lambulić put cocaine on the market in the territory of Serbia and Montenegro, Germany and Norway.
