The Council for Citizen Control of the Police determined that Aleksandar Tošić (28) had his human rights violated by "inadequate application of police powers" during the "NATO Day" event in Podgorica in April of this year.
"The council assesses that the situation in which the citizen AT found himself, in connection with the delivery of the summons to access the official premises, was unnecessary, and that it indicates a certain disorganization and unprofessionalism in the police action which exposed the citizen AT to unnecessary harassment", he states. in the conclusion of the Council.
They also add that they registered the incompleteness of the summons delivered to the citizen AT, "due to which there was a significant violation of his rights, because the summons did not specify the reasons for which the citizen is invited to immediately access the official premises of CB Podgorica".
Tošić was taken to the police station for no reason on the day of the event.
He then claimed that he had only gone to buy bread for his family.
"The council, through working on several cases, pointed out the negative practice in connection with the delivery of invitations in which the reason for the invitation was not indicated and issued several recommendations to stop such practice. In this regard, several court proceedings were conducted against the Ministry of Internal Affairs and the State of Montenegro for the compensation of non-material damages due to the violation of personal rights, some of which have already been legally terminated", the council states.
The Council registered, in the Report on the control performed upon application, a number of contradictions and ambiguities, and therefore a recommendation is made to pay additional professional attention and brevity to the compilation of official documentation.
