Šaranović is asking to be released, claiming that he is in custody illegally

Slobodan Šaranović from Danilovgrad, accused of organizing the murder of Nikola Bojović from Belgrade, claims that he has been illegally detained for a month.

He wrote in a letter sent to the management of the Spuška prison that his 30-day detention was extended for the last time on October 17 and that the panel of the High Court did not issue a new decision on the extension, although they were obliged to do so by November 16.

"In Article 179 para. 2 of the Code of Criminal Procedure, it is expressly stipulated that the Council is obliged, at the proposal of the parties or ex officio, to examine whether there are still reasons for detention and to issue a decision on the extension or cancellation of detention, after the expiration of every 30 days until the indictment is filed. legal force", Saranović wrote.

In the same text, he reminds that the case against him is being conducted before the Higher State Prosecutor's Office in Podgorica, that it is still in the investigation phase and that the council was therefore obliged to decide on custody again.

"The fact that the council, from that day until today (December 15), has not issued a decision on the extension of detention in relation to me, means that I have been detained absolutely illegally for a month already. For this reason, I demand from the prison administration that I be released immediately," the letter that was sent to the Spuša prison administration reads.

Rodić: Violation of human rights

Šaranović's lawyer, lawyer Goran Rodić, told "Vijesta" that such action by the High Court represents a drastic violation of the provisions of the CPC and a violation of the right to freedom "as one of the basic human rights guaranteed by Article 5 of the European Convention on Human Rights and Freedoms".

"Already before, with numerous judgments of the European Court of Human Rights in Strasbourg, such illegal actions by state bodies - courts, were recognized and established as a violation of human rights," said Rodić.

He pointed out that, in addition, the decision to extend Saranović's detention is also particularly questionable, "taking into account his age, health condition and previous relationship with the judicial authorities".

In the indictment against Šaranović and Ratko Koljenšić, it is written, among other things, that the Danilovgrad, together with Miloš Delibašić from Belgrade, organized a criminal group to commit several serious crimes on the territory of Montenegro and Serbia. It is stated that Šaranović believed that Luka Bojović, the alleged head of the so-called Zemun clan, was responsible for the death of his brother Branislav in 2009 and that he therefore wanted to take revenge. It says that he reached an agreement with Delibašić and Saša Cvetanović to kill Luka's brother Nikola for money, which they did on April 29, 2013.
