One of the directors of Hipo Alpe Adria bank, Nemanja Boljević, who was at the head of Hipo Alpe Adria leasing at the time of signing the contract on the mortgage on the house of the Dudić family, said that he was not involved in agreeing the conditions under which such a contract was signed, although he signed.
He said this in the repeated dispute that the widow of Dragan Dudić Fric initiated in order to return part of the property that was transferred to the ownership of Hipo Alpe Adria leasing, due to the unpaid loans of her late husband.
"I don't remember that anything was disputed regarding this contract. The legal service prepared the contract and I signed it," said Boljević.
When asked by lawyers Zorica Đukanović and Zoja Dudić - whether the conditions for the conclusion of the contract are agreed upon at the level of the director or the legal department, and whether he remembers that the mortgage on the house was placed afterwards, Boljević said that the conditions for the conclusion of the contract are agreed upon above the legal department, but that he did not participate in it.
"The mortgage agreement was signed after the leasing agreement, but as far as I know, additional security was requested because of the delay under the leasing agreement," he said.
Officials of the legal service will also be heard
Judge Ana Perović-Vojinović decided to hear the then employees of the legal department in the bank Nataša Đelević and Danil Radulović at the next hearing on September 29.
By the decision of the Administrative Court, the widow of the murdered resident of Kotor was previously left without the family home, the "Maksimus" discotheque, several business premises in the center of Kotor and about 3.000 square meters of land.
A few months ago, the High Court overturned the first-instance verdict of the Basic Court that Dudić should return part of the property, which was transferred to the ownership of Hipo Alpe Adria Leasing in the name of an unpaid loan of more than seven million euros, raised by the company "Sekondo Porto".
Dudić sued Hipo Alpe Adria Leasing, claiming the nullity of the real estate sales contract, financial leasing and mortgage, stating that the bank concluded the disputed contracts with her now-deceased husband without her knowledge and consent, even though it was joint property acquired during marriage.
After the annulment of the decision of the High Court, she, by their order, expanded the lawsuit by naming her children Damjan and Srdjana Dudić as the second and third defendants, and the fourth defendant was her late husband's former company "Sekondo porto".
