The trial for the murder of Marko Vesnić: Can the accused see each other in the dark?

Lawyer Dragoljub Đukanović objected to the minutes of the reconstruction of the murder of Belgrade citizen Marko Vesnić, saying that the employees of the Public Utility Company Bećir Bećiraj and Branko Đurđević could not recognize the accused because of the darkness and dense vegetation in the park.

The reconstruction was carried out on March 5, 2013, starting at 5 am.

Yesterday, the retrial of Vladimir M. Roganović, Duško N. Roganović and Dražen Čađenović, accused of having killed Vesnić and wounded Ivan Marković as co-perpetrators in 2009, continued in the High Court.

Đukanović, on behalf of the defense of the defendants, reminded that the decision of the Appellate Court, which annulled the previous conviction, ordered that the complete reconstruction should begin at the time when Vesnić was killed - around 4 o'clock in the morning.

"This is because the conditions and the ability to observe circumstances and recognize persons would be adequate. The court started at 5 o'clock, but did not perform a complete reconstruction of the murder. Duško Roganović's right to defense was violated in this way. The only thing that links him is the identification record that they took from the PUK worker at the police premises in Hecerg Novi," said Đukanović.

He repeated that the request of the defense was never respected - that the workers of the PUK Bećiraj and Đurđević, from the foot of the garbage truck, where they were standing on the night of the murder, identify Roganović.

"This is a key moment for solving this case, because from the position where the witnesses Bećiraj and Đurđević were, due to the park, dense vegetation and darkness for about 4 hours, they could not recognize anyone. You can't see anything at all. This can be seen in the photo-elaboration, that the vegetation obscures the bench and in the dark one cannot recognize anyone. The defense proposed that the recognition be done in daytime conditions as well, because we claim that the contours of the person sitting on the bench or standing next to the bench cannot be seen either," said the lawyer.

According to the indictment, on July 24, 2009, Roganović and Čađenović killed Vesnić and wounded Marković near the Youth Park in Igalo according to a prior agreement.

After they left the "Casa" discotheque, while Vesnić was sitting on a bench, they attacked him by Vladimir Roganović and Čađenović stabbing him in the left forearm and upper leg with a knife.

"Duško Roganović fired two shots at Vesnić, two of which hit him in the stomach, and a shot in the right lower leg and right knee, while two shots hit Mirković. The defendant Vlaović provided them with an apartment in the villa 'Monaco', bringing them food, water and mobile phone cards," the indictment reads, among other things.
