Baran's Isat Boljević was sentenced to nine months in prison and will pay a fine of 50.000 because, as the chairman of the board of directors of the New Tobacco Plant, without the authorization and knowledge of the owner, he took cigarettes worth almost 7,5 million euros from the warehouse of the tobacco factory, and then transferred them to rented warehouses in Karabuško polje, near Podgorica.
Thus, the High Court accepted his settlement with the Special Prosecutor's Office, when he admitted that he was guilty of abuse of position in business operations.
He is accused of abusing his position in the period from March 2016 to March 2017.
"Acting on behalf of a legal entity as an authorized representative of the President of the Board of Directors, he issued verbal orders to the employees of the company for the production of finished tobacco products-cigarettes intended for export of the brand "A1" in the amount of 1.091 packs, i.e. 545.500 packs, "Virginija King" in the amount of 3.251 packages, i.e. 1.625.500 packs, "Like Silver" in the amount of 70 packages, i.e. 35.000 packs, "President" in the amount of 10 packages, i.e. 5.000 packs, "Fancy" in the amount of 54 packages, i.e. 27.000 packs , "Mac" in the amount of 3.400 packages, i.e. 1.700.000 packs of cigarettes", it is written in the agreement that he signed with the prosecution, and which the court accepted.
It is added that Boljević demanded that the production of cigarettes not be entered or recorded in the business documentation, in order to conceal the production of cigarettes.
"And that in the amount of 12.000 packs of cigarettes of different types, one part of which, 7.876 packs of cigarettes, i.e. 3.938.000 packs of cigarettes, whose total cost price is 397.800,00 euros, and the retail price of which is 7.482.200 euros, he confiscated and appropriated by transporting the cigarettes in question, which are excise products under the deferred payment regime, contrary to Article 7 paragraph 1 point 3 of the Excise Law, from a warehouse to a warehouse that he rented as a natural person for the amount of 5.000 euros, and in order to continued to sell on the gray market, and in this way he avoided paying excise taxes and other duties in the amount of several million euros, and thereby obtained an illegal financial benefit of at least 397.800,00 euros," the agreement reads.
The investigation did not determine who the cigarettes were intended for.
