Podgorica Basic Court Judge Željka Jovović will decide on Friday whether Ivan Bušković, accused of attacking "Vijesti" journalist Olivera Lakić, committed the criminal offense of violent behavior, for which a sentence of six months to five years in prison is provided.
Bušković is accused of physically assaulting Lakićeva in front of her building on March 21.30th around XNUMX:XNUMX p.m., on Bulevar Svetog Petar Cetinjski, for no reason, while she was unlocking the front door on her way home from work.
Prosecution counsel Miloš Šoškić, in his closing remarks, pointed out that the defendant did not provide any details in his defense in accordance with the witnesses who claimed that they played football with him on the disputed evening, while, on the other hand, the completely consistent and precise testimony of the injured party clearly indicated that Bušković is the attacker.
"The defendant claimed that on March 21, from 22 to XNUMX p.m., he played football with four boys, who stated that they did not play football that night, nor were they on the field where football was played. Bušković claims that that night he was wearing gray tracksuit bottoms and a green sweatshirt with a hood, while the witnesses, who claimed that he played football with them, stated that he always plays football in a gray Ribok brand tracksuit", he said, among other things, Soškić.
Lakić recognized him
He also reminded that Bušković claimed that after football he went home and did not go out again, which was also denied by the statements of witnesses who said that they were with him or saw him in front of his cousin's house, where they let the dogs out.
"On the other hand, during the identification process, the injured party unequivocally pointed to the defendant as the person who committed the crime, and at the main trial she remained consistent and conscientiously pointed out to us that the defendant attacked," said Šoškić.
He added that the court must appreciate numerous aggravating circumstances when making a decision, namely that he approached the woman from behind, that he used the moment to attack her when she was unlocking the door and punched her without any reason, as well as that he has been convicted several times before.
Hajduković: Police unable to find the real attacker
For the defendant's defense attorney, attorney Darko Hajduković, the fact that the testimony of the witness and the accused do not agree is completely insignificant, and Bušković's inaccuracy in counting the persons who played football with him on the disputed night is characterized as the defendant's spontaneity.
"They play football three times a week on the same field every Sunday and can they remember the insignificant details of who came with whom, what they were dressed in and who was all at football," said Hajduković.
He added that Lakić was misled by individuals from the Police Administration, with their inability to find the real perpetrator.
"They found Bušković, who was on the run because of a previous conviction, and who, as soon as he heard why they were looking for him, came to the police and unsuccessfully demanded a lie detector. "An unprecedented media campaign and condemnation was immediately started, and individuals from the top of the government publicly announced that he was the perpetrator," said Hajduković in his final presentation.
Bušković pointed out that he did not attack Lakićeva, and that he had no reason to attack her, because he did not know her at all.
"Give me five times the sentence, I would only like me and Lakićeva, when all this is over, to take a polygraph to see who is telling the truth," Bušković said.
Lakić has been the target of harassment and threats since last February, and it all started after she started writing articles about the tobacco factory "Tara" in Mojkovac. In the Basic Court in Podgorica, a month ago Slavko Music, an employee of the "Montenegro tobacco company" factory, was sentenced to four months in prison because on the third of February last year, he blocked the car of the "Vijesti" team with his vehicle, near the hangar in Donja Gorica, and then with three unknown persons. stood in the yard of the house where Lakićeva was, in order to scare her and the family she was talking to, who live behind the wall of the hangar where the packaging of fake cigarette brands is allegedly produced. Milan Grgurević from Danilovgrad was recently sentenced to a year in prison because he falsely reported that he had threatened Lakić and her daughter, and the retrial will begin in September. The perpetrators of these attacks, intimidation and threats are still an enigma.
Due to the security assessment, the "Vijesti" journalist and her family received permanent police protection on March XNUMX, two days after the attack, and she then decided to temporarily retire from journalism.
Adžić: A pre-planned attack
Lawyer Miladin Adžić, attorney for Lakićeva, assessed that this was a prepared and pre-planned attack, in which the basic rule is that the perpetrators try to leave as few traces as possible that would contribute to the investigation, and on the other hand, to provide evidence in case they are suspected. .
"The court must bear in mind that the defendant is the perpetrator of an ordered criminal act, because he had no reason or reason to commit a criminal act, they are particularly dangerous, so the court must impose stricter sentences on them," said Adžić.
There are no missed calls in the listings
To the question of Miloš Šoškić, the representative of the prosecution, whether the provided lists of the operators register only the communication made or the missed calls, the telecommunications expert Predrag Boljević stated that, unfortunately, contrary to the Law, the operators register only the calls that generate income for them and submit them to the court.
