The mother of murdered convict Dalibor Đurić, Nevenka, said yesterday that she learned on TV that her son was wounded in prison on September 22 last year.
"I screamed, and as I was in the presence of my grandson, I went to the toilet and when I got out I saw that my son had died," she said.
Đurić said this in front of Nikšić Basic Court judge Marko Blagojević, who in the next 30 days will make a decision on the lawsuit filed by the mother, wife and children of the late Dalibor Đurić, seeking 300.000 euros in compensation from the state.
A native of Kotor was killed in the gym of the semi-open part of the Spuš prison.
In the Nikšić Basic Court, the evidentiary proceedings were completed yesterday, during which Đurić's mother, Nevenka, and his wife, Aleksandra, were heard.
Aleksandra said that she heard from her husband before he left for training, because Đurić was in a semi-open section of the penitentiary.
She added that soon after that, a friend called and told her that something was happening at ZIKS:
"I called Dalibor, but someone else answered his number and told me that he was wounded. While I was driving to Podgorica, the news that he had died had already appeared on the portals. The pathologist called us the next day, when we went to the Clinical Center let's take over his body, he said that Dalibor was dead on the spot".
In the courtroom, she explained that their older son, who is four years old, knows that his father is not alive, while their younger son, who is less than three years old, has not been told that yet. The state representative did not attend the hearing.
Judge Blagojević revoked the court's decision from October 4, 2017 in the part of the medical expert examination that will not be conducted, citing the fact that the European Court of Justice does not conduct expert examinations for mental pain, and neither has the High Court since 2013.
Presenting the evidence, the representative of the Đurić family, attorney Anja Ivanović, said that the allegations from the response to the lawsuit are unfounded and contradictory, because the report states that Đurić was not allowed to go home for the weekend due to security reasons, and was placed in a semi-open ward, as well as that the place of execution of the criminal offense was outside the complex of the Institution, although the murder took place inside ZIKS.
In her final statement, she requested that Đurić's claim be accepted, that the defendant undertake to pay the prosecutors the costs of the proceedings, as well as to refund the funds for the expert's costs... Đurić was killed in the gym of the semi-open section of the KP Dom. The police and the prosecution claim that Dejan Pavićević (45) and Miloš Trbo (31) from Kotor provided transportation to the killer, transmitted messages and destroyed traces and evidence of the liquidation of Đurić.
The investigators did not find out who liquidated the alleged member of the Skaljar clan, as well as the perpetrators of that crime.
