Montenegrin prosecutors have not yet determined whether any of the officers of the Spuška prison are responsible for the murder of convict Dalibor Đurić on September 22, 2016. The Podgorica Higher Prosecutor's Office replied to "Vijesta" that the case was forwarded to the Special Prosecutor's Office.
"I inform you that the case, which was established in the Higher State Prosecutor's Office in Podgorica regarding the murder of D.Đ., on 04.10.2016 submitted to the jurisdiction of the Special State Prosecutor's Office", announced prosecutor Lepa Medenica.
"Vijesti" asked the higher prosecutor's office whether it was determined whether there were any omissions by officials of the Institute for the Execution of Criminal Sanctions in the case of the murder of Đurić, and if so, against how many officials and for what criminal offense the investigation was initiated.
The Supreme State Prosecutor's Office announced earlier that they are taking all necessary measures and actions to shed light on the murder of prisoner Đurić.
Supreme State Prosecutor Ivica Stanković then announced that the Prosecutor's Office is simultaneously investigating all the circumstances under which the murder occurred in ZIKS.
"If, during the investigation, it is established that a criminal offense has been committed in the actions of ZIKS officials or any other institution, for which prosecution is undertaken ex officio, the Prosecution will react adequately in such eventualities," said Stanković.
Đurić was killed in the gym of the Semi-Open Department of the Correctional Facility.
He was hit in the chest by a sniper's bullet.
After the liquidation of Kotorana, the police in Rogami, near Duklja, found a burning "shkoda", which was used by the attackers.
Dejan Pavićević and Miloš Trbo from Kotor are on trial in the Podgorica High Court for complicity in the murder of Đurić.
They are accused of significantly contributing to as yet unidentified persons to kill Đurić in an insidious manner and out of self-interest.
In the files of the Special State Prosecutor's Office, it is explained that they are part of a criminal group formed in May 2016, with the task of liquidating the now deceased member of the Skaljar clan.
Prosecutors, however, have not yet revealed who the organizer is, but neither have the other members of that mafia group...
According to their claims, that clan was preparing several criminal acts of drug smuggling, illegal possession of weapons and serious murder...
Prosecutor Saša Čađenović claims in the explanation of the indictment that material traces have proven that on September 22, 2016, Pavićević and Trbo waited in a Danilovgrad cafe for the executor to liquidate Đurić, and then went to destroy the traces.
Both men denied any involvement in the murder at the trial.
Đurić was registered in the police records as a member of the Skaljar clan, which is allegedly headed by Igor Dedović from Kotor and the brothers Jovan and Igor Vukotić.
All three have previously denied the allegations of the police, claiming that they had nothing to do with the clan.
Đurići v. the state in the Nikšić Basic Court
In the Basic Court of Nikšić, the proceedings will soon begin based on the lawsuit filed by the family of the deceased Đurić against the state.
Đurić's wife, Aleksandra, their minor children, and Đurić's mother, Nevenka, are demanding EUR 300.000 in compensation.
The representative of the Đurić family, lawyer Zoran Piperović, previously explained to "Vijesta" that they are asking for money in the name of material and non-material damages.
The lawyer then explained that the basis for the lawsuit was indisputable:
"The state is obliged to protect its subjects who are serving a sentence or in custody, and it is clear that the basis here is stronger, the more before the prison administration and other security services knew that the late Dalibor was in danger, because there had already been an attempt to kill him once before and that's why they should have taken into account the regulations that regulate the custody of such persons in that institution and to preserve his life even while he is with them", said the lawyer earlier.
In their lawsuit, it is written that in accordance with the provisions of the Law on Execution of Prison Sentences, Fines and Security Measures, the state was obliged to take into account the safety of Kotor residents when housing prisoners.
As evidence that the ZIKS administration knew that Đurić's safety was at risk, the court was presented with documentation that the Spuš prison administration denied Đurić the benefits of spending the weekend with his family, treatment outside the premises of ZIKS... "referring to the opinion of the Police Administration regarding security assessment of the said prisoner".
