The Office for Combating Corruption of the Municipality of Budva submitted a criminal complaint to the Special Prosecutor's Office against the former director of the Grad Theater, Blaž Radoman, on the suspicion that he abused his official position and damaged that public institution for several tens of thousands of euros.
The office headed by Veljko Vujović acted on the application of the acting executive director of the Grad Theater, Milena Lubarda Marojević.
In the documentation submitted to the prosecutors, they exhaustively listed seven points in which Radoman allegedly violated the law...
Radoman told "Vijesta" that he rejects their claims and announced that he too will file criminal charges against Lubarda Marojević and the Council led by Siniša Jelušić.
In the criminal complaint, which "Vijesti" had access to, it is written that the disputed purchase of the company car was a "Volkswagen", because the seller was not legally in possession of the car, but the traffic license read for a certain Nikšić resident.
"On February 15, 2016, a resident of Nikšić leased the same vehicle to a company from Budva, which leased the same vehicle to the director, in the period from February 15 of last year to February 15 of this year. From the purchase and sale of the vehicle, expenses were incurred, two accumulators of different amperage and additional four tires of different profile, which do not match the mentioned vehicle, as well as other expenses that are stated in the official note by the head of the technical service", according to the criminal complaint.
An invoice of 4.000 euros, paid to a company from Budva, was also delivered to the prosecutors.
The report also states that Radoman, instead of the 2.000 euros prescribed by the Law on Prevention of Fraudulent Business to be the cashier's maximum, reversed the decision and signed a new one in which that amount was increased to 5.000 euros.
The criminal report states that during 2016, the company Gugi komerc issued several invoices to the Grad Theater, several of which are disputed...
"Invoice number 5226, forklift services were invoiced six times, although the forklift was used only twice, and the construction material shown in the invoices was not taken for the needs of the Grad Theater, which the head of the technical service confirmed in a letter to the director.
Allegedly, the selection of food service provider by Radoman is also disputed.
"After announcing the tender for the provision of food services during the 30th Grad Teatar festival, only one bidder responded to the tender, the value of the purchase was 15.000 euros. The contract was concluded on May 31, 2016 for the amount of 14.500 euros. The use of services with the selected bidder is abandoned and another company from Budva is hired, with which no contract was concluded, and a new public procurement procedure was also not implemented. The contract could not be implemented by direct negotiation, since the value of the procurement was greater than 5.000 euros, which violated the Law on Public Procurement".
Radomana is charged with providing technical support services for the implementation of last year's festival.
"A tender is being announced and the only bidder was a company from Podgorica. The value of the purchase was 36.000 euros, the contract was concluded at 35.997,50 euros, while the price of services based on the invoice was 44.921,36 euros, which exceeded the tender maximum by 24,78 percent, and the permitted deviation is 10 percent.
It also says that the disputed severance pay is for the DA employee, who was set the amount of 7.132 euros by decision, while Radoman issues a decision increasing that amount to 8.868 euros.
The application also includes the payment of one-time assistance to an employee of MK in the amount of 4.000 for the treatment of a serious illness.
"It is unclear how the one-time aid was calculated, when there is no medical documentation in the personnel file on the basis of which the aid was calculated in the maximum amount of 7.543,80 euros," the application states.
Radoman said that he is sure that his application is sanctifying him because he was pointing out the illegitimacy of the decisions made by the City Theater Council.
"I am convinced that the criminal charges will be dismissed. This application proves the incompetence and legal and financial ignorance of the current management of the Grad Theater. Every decision I made was legally based and was public, it was in the archives of the Judiciary. Each of the employees, including Lubarda Marojević, who was my deputy, during the two and a half years that I was at the head of the Grad Theater, if she was busy with her work, could read and make an official note, if there were any omissions. They didn't even do it verbally. It will be proven that I did everything according to the law," Radoman said.
Contracts of 40.000 were eventually paid 200.000 euros
Radoman said that he is convinced that the competent prosecutor's office will deal with the work of Lubarda Marojević while she was the director of JRDS Television Budva: "Where are the individual contracts she signed for 40.000 euros, in the end paid for 200.000 euros".
He said he would not allow his name to be tarnished.
"Initiators and filers of criminal charges will bear legal responsibility. Then we will not be guided by the fact that ignorance of the law exempts from responsibility. I am telling them that I will file criminal charges against them because of the decisions they made for this year's festival - from the choice of technical support to the program and violation of the law," said Radoman.
"The audit of the business was done in a dilettante manner"
Radoman stated that the initiative for the criminal complaint was based on a "completely dilettante audit of the business".
"The selection of the auditor and the course of the audit was carried out completely contrary to the Statute of the Public Institution. The audit was conducted by council members Siniša Jelušić and Slobodan Bobo Mitrović. I applied twice to the JU to be granted the legal right to attend the audit in the institution's premises, as it relates to the period when I was the executive director. The first time I was silenced, and the second time I was told that they would call me if there was a need. When the independent auditor submitted the draft of the audit, it was not handed over to me in order to give written remarks, comments and suggestions, which is surprising. I am convinced that the report would not have been like that if I had been allowed to attend," said Radoman.
