The alleged head of the Skaljar clan, Jovan Vukotić, was acquitted of the charge that in July 2012 he wounded the security guard Dejan Deković at the Tivat discotheque "Madam Coco".
Because of the same event, Vukotić's brother, Igor Vukotić from Kotor, was sentenced to eight, and their fellow citizen Jovan Jovanović to 14 months in prison.
Judge Momirka Tešić of the Basic Court of Kotor handed down the sentence to the alleged heads of the Škaljar clan and their associate Jovanović yesterday.
Brothers Vukotić and Jovanović were acquitted by the first-instance verdict of having wounded Deković on July 17, 2012 in a Tivat discotheque.
Explaining the verdict, Judge Tešić stated that Igor Vukotić and Jovanović were guilty because that night in the discotheque "Madam Coco" they caused a danger to the life and limb of Deković and several people present in the bar.
"In the way that both defendants, upon entering the catering establishment, from one of three pistols of an unknown brand, two of which were of 7,65 mm caliber and one of 9 mm caliber... fired several projectiles in the direction of the victim and those present, from of which one of the projectiles hit Deković Dejana, causing minor physical injuries to him", it is written in the explanation of the verdict.
The judge extended the custody of Jovanović, reasoning that it can last until the verdict becomes final, and the longest until the prison sentence expires - on April 9, 2018.
"Unthinkable court decision, contrary to all testimonies"
"In a case in which not a single witness brought the defendants to the domain of guilt, in which the injured party claims that the defendants did not shoot at him, the first-instance court, acting only on orders to hear some witnesses, makes a completely unimaginable sentencing decision in one part.
It is impossible to decide on an event like this because all the witnesses declare identically that none of them fired, so it remains incomprehensible how he determined for the defendants Igor Vukotić and Jovan Jovanović that they were the ones who caused the general danger and that Jovan Vukotić did not," he announced yesterday. To "Vijesta" the defender of the accused, lawyer Branko Anđelić.
