The family of the late Dalibor Đurić sued the state for the murder of a Kotor resident in Spuša prison.
His wife Aleksandra, their minor children, and Đurić's mother Nevenka are demanding EUR 300.000 in compensation.
The representative of the Đurić family, lawyer Zoran Piperović, confirmed to "Vijesta" that they submitted a lawsuit to the Basic Court in Podgorica and that they are asking for money in the name of material and non-material damages:
"On the basis of his death in the Institute for the Execution of Criminal Sanctions. I hope that someone will act on behalf of the state and try to end this dispute with a bargain," said the lawyer.
Piperović claims that the basis for the lawsuit is indisputable and that he is certain that the litigation will be short-lived.
"The state is obliged to protect its subjects who are serving a sentence or in custody, and it is clear that the basis here is stronger, the more before the prison administration and other security services knew that the late Dalibor was in danger, because there had already been an attempt to kill him once before and that's why they should have taken account within the framework of the regulations that regulate the custody of such persons in that institution and to preserve his life at least while he is with them", said the lawyer.
He added that he hopes that the answer to the lawsuit will arrive very soon.
"If the state decides to invite us to settle, if they offer an amount that is reasonable, which means about 300.000 euros, which is what we asked for, we are ready to settle," he said.
In the lawsuit submitted to the Basic Court in Podgorica, which "Vijesti" had access to, it is written that the state, in accordance with the provisions of the Law on Execution of Prison Sentences, Fines and Security Measures, was obliged to take into account the safety of the residents of Kotor during the placement of prisoners.
As proof that the ZIKS administration knew that Đurić's safety was at risk, the Basic Court received documentation that the Spuš prison administration denied Đurić benefits - spending the weekend with his family, treatment outside the ZIKS premises... "referring to the opinion of the Police Administration regarding for the security assessment of the said prisoner".
Đurić was killed on September 22, 2016.
A bullet hit him in the gym of the Semi-Open Department of the Penitentiary Home, around 18.15:XNUMX p.m.
Half an hour later he died in the hospital.
The police and the prosecution claim that Dejan Pavićević (45) and Miloš Trbo (31) from Kotor provided transportation to the killer, transmitted messages and destroyed traces and evidence of the liquidation of Đurić.
The two were arrested a few hours after the murder, but the investigators did not discover who pulled the trigger and killed Đurić, as well as the perpetrators of the crime.
The police identified the murdered man from Kotor as a member of the so-called Škaljar clan, which is allegedly headed by brothers Jovan and Igor Vukotić and Igor Dedović.
Inspectors believe that he is also a victim of the cocaine war, which has been raging among Montenegrin criminal clans since the end of 2014, after a load of several hundred kilograms of cocaine was stolen in Spain. The result of that war were dozens killed and wounded. Among the dead, investigators also recorded accidental victims.
