Svetozar Marović's fine will be replaced by a prison sentence, when the High Court is convinced that the man from Budva does not intend to pay 100.000 euros to the budget or that he does not have the money.
This was answered by "Vijesta" yesterday from the High Court of Podgorica.
The former statesman and official of the Democratic Party of Socialists has not yet paid the fine according to the verdict of the Podgorica High Court, although his legal defender Zdravko Begović announced ten days ago that the Budvanin will soon repay the debt to the state.
Begović said two days ago that nothing else comes to Marović's mind right now - except to get out of the health situation.
"We inform you that Svetozar Marović has not paid the fines to which he is obligated according to the judgments of this court. Pursuant to the provisions of Article 39 paragraph 6 of the Criminal Code, in case of non-payment, the fine will be replaced by a prison sentence of no longer than one year", said the High Court.
Responding to the "News", they explained that the Law does not provide for a specific deadline when it will be decided to replace a fine with a prison sentence:
"And the reasons point to the fact that before the decision on substitution, the court is convinced that the convicted person does not have the intention or financial means to pay the fine, in order not to get into the situation provided for in Art. 39 paragraph 6 of the CC, that after replacing a fine with a prison sentence, it is suspended," the court said.
The former president of the state union of SiCG agreed with the prosecutors to pay 100.000 euros to the budget of Montenegro, no later than three months after the judgment becomes final.
The agreement specifies that the court will replace the fine with a prison sentence if he does not pay within the stipulated time.
Begović said two days ago that "too much dust has been raised around that fine", explaining that it is in the interest of his client to pay so that the prison term is not extended.
"Vijesti" announced on March 30 that Marović's prison sentence could be increased by 12 months, because he did not pay two fines of 50.000 euros each.
The spokeswoman of the Podgorica High Court, Aida Muzurović, confirmed the information of "Vijesta" that day, announcing to the media that Marović's fines will be replaced by imprisonment.
Marović could be behind bars for the next few days, because the Basic Court of Kotor rejected his request to postpone the execution of the prison sentence as unfounded.
The decision was made by the president of the Basic Court in Kotor, Branko Vučković, after the court medical board of the Faculty of Medicine in Podgorica submitted a report stating that the health was impaired.
It is possible to treat Marović medically in the Institute for the Execution of Criminal Sanctions.
Begović pointed out that he will file an appeal with the Podgorica High Court on the grounds that Marović's state of health is very bad.
Marović settled with the prosecutors on a prison sentence and a fine, after admitting that he led a criminal group that damaged the budget of Budva by tens of millions of euros.
On the basis of two agreements, he was sentenced to three years and 10 months in prison, a fine, payment of court costs and to repay the state over one million euros.
Marović's son Miloš should also have been in Spuška prison a long time ago, after admitting that he participated in illegal transactions worth millions in connection with the purchase and sale of a plot of land on Jaz.
He, too, is delaying going to prison, and he recently received Serbian citizenship. According to unofficial information, he is now trying to serve his sentence in Serbia, under so-called house arrest.
Justice Minister Zoran Pažin recently reiterated that the Marovićs will serve their prison sentences in Montenegro.

According to the verdict of the Podgorica High Court, which accepted the settlement between Marović and the special prosecutors, Marović is obliged to pay two fines of 50.000 euros each.
"Which the defendant is obliged to pay for the benefit of the budget of Montenegro within three months from the date of finality of the judgment rendered on the basis of the plea agreement, and if the defendant does not pay the fine within a certain period, the court will replace it with a prison sentence by a twenty-five euro fine and a one-day prison sentence," says the confirmed agreement.
It was clarified that a fine cannot be replaced by a prison sentence longer than six months, that is, Marović cannot be imprisoned for more than a year due to the unpaid 100.000 euros.
The convicted politician admitted to the prosecutors that he was the head of the Budva criminal group, which damaged Budva's coffers by several million euros through embezzlement.
