In his closing speech, special prosecutor Živko Savović dropped the criminal prosecution against the former president of Nikšić Municipality, Nebojša Radojičić, accused of prolonged criminal offense of abuse of official position.
The prosecutor said that taking into account the findings of financial expert Milenko Popović, there is no evidence against Radojičić.
After that, today in the High Court in Podgorica, Judge Suzana Mugoša delivered a verdict rejecting the accusation.
The indictment stated, among other things, that in the period from January 1 to December 31, 2012, Radojičić, in his capacity as an official, President of the Municipality of Nikšić, by exceeding the limits of his official authority, obtained benefits for the legal entities "Radulović - M3 doo Nikšić ", Cinema servic doo Pančevo, "Kino Akustika" doo Pančevo, "Ramel" doo Nikšić and "B Film Montenegro" doo Podgorica.
The indictment alleges that the defendant Radojičić seriously violated the rights of other interested potential bidders, while he was aware of his act, wanted its execution and knew that his act was prohibited and illegal.
During the procurement of goods and services for the adaptation and renovation of the theater hall "Scena 213 - SINDČEL" in Nikšić, the defendant acted contrary to the Law on Public Procurement, without implementing the appropriate public procurement procedure, by uneconomical and irrational use of public funds, without ensuring equal competition among the bidders, the mentioned legal entities benefited and severely violated the rights of other interested potential bidders to participate in the public procurement procedure.
