A US court has dismissed Spencer Elden's latest lawsuit against the former rock band Nirvana over the cover of the iconic 1991 album, which featured him naked as a baby.
Elden, 31, said his appearance on the cover of "Nevermind" constituted child sexual abuse. However, the judge in charge of this case explained that Elden waited too long to claim that he had been exploited, reports N1.
Elden's legal avenues are now all but exhausted, as he cannot refile the lawsuit, although his legal team has told US media they will appeal the ruling.
The lawsuit focused on a photo of Spencer Elden, which shows him swimming naked in a pool toward a dollar bill pierced with a hook.
Elden claimed that he himself could not have consented to the image being used. He sought $150.000 in damages.
The accused were members of "Nirvana" Dave Grohl and Chris Novoselic, Courtney Love (widow of former singer Kurt Cobain), several publishing houses and photographer Kirk Weddle.
"Nirvana" used a photo Weddle took on the cover in 1991 in Pasadena, California.
More than 30 million copies of the album "Nevermind" have been sold.
