On December 30, a convict called Niški hit the prisoner Dejan Šćepanović on the head with a bar, not Milan Brajović, aka Fitilj.
This is what witness Aleksandar Perović said yesterday during the continuation of Brajović's trial.
In front of Danilovgrad Basic Court Judge Sonja Keković, he explained that he did not see Niški hit Šćepanović, but that all the prisoners knew it and told him so.
Brajović then explained that Niški was the nickname of convict Marko Savić.
Brajović is accused of hitting Šćepanović on the head with a metal rod on December 30, 2017, in the Spuška prison, causing minor bodily injury.
Šćepanović was injured in the corridor of pavilion F, while Brajović and convict Ljubiša Đurišić were leaving the prison room for a walk.
Đurišić claimed yesterday that the corridor was full of "prisoners who should not have been opened".
"They should have been closed for those ten seconds while we left the room for a walk, because we are in isolation. I was saying goodbye to some prisoners from other rooms, I saw a crowd, I didn't see who hit Dejan Šćepanović, but I knew it wasn't Milan Brajović, because he was next to me the whole time," claimed witness Đurišić.
Answering the accused's question, he said that as a rule, no one is allowed to be in the corridor when they pass, because they are under a special regime due to isolation.
Witness Petar Damjanović said that on that day, when he heard shouting, he came out of the living room into the hallway and saw Šćepanović leaving his room with his head cut open.
"I saw a large number of convicts and the commander Branislav Savović, Dejan Šćepanović, running out of the room with their heads cut off. I did not see who hit him, nor that he was arguing with anyone. Brajović was on my left, and Šćepanović and a group of convicts on the right. When I went out into the corridor, a metal bar flew by, hit the wall and fell to the floor. I don't know who threw it," he said.
Prosecutor Vukas Radonjić said that he had objections to the statements of all three witnesses, but that he would state them in his closing statement.
He requested that the difference between Damjanović's testimony and what can be seen on the video of the surveillance cameras be stated.
Keković ordered that Savić be heard and accepted Brajović's proposal to obtain from ZIKS all the recordings from the corridor of pavilion F and the room where he and Đurišić are staying.
Prosecutor Radonjić did not object to that proposal either.
Brajović was convicted for the murder of Tihomir Bojović from Nikšić.
The camera recorded Šćepanović's bloody head, not the blow
In the courtroom yesterday, a video from one of the surveillance cameras from the Spuša prison was shown, showing an injured Šćepanović, but not who hit him.
In that video, you can see Brajović and Đurišić running into each other in the corridor.
The camera recorded that one of the convicts was holding his head with his hands, and that at that moment Savić was passing by him.
After that, commander Savović pushes Brajović back, and not long after, Šćepanović comes to the grate behind which Brajović is pouring blood down his head.
Brajović claimed in the courtroom that the injured prisoner then asked him if he saw who hit him.
