The family of the girl, who was hit by Srđa Brajović (44) from Podgorica with a car at the pedestrian crossing, appealed against the verdict which sentenced him to five months in house arrest.
"Against decision K. no. 357/18 of October 26, 10, an appeal was filed on November 2018, 5, by the legal representative of the injured party," the Podgorica Basic Court told "News".
According to the knowledge of "Vijesti", the family is asking for a stricter sentence for Brajović.
He previously agreed with the prosecution to spend his sentence in residential premises, and the court accepted such an agreement.
With the plea agreement, Brajović was sentenced to four months in prison for a serious crime against traffic safety and two months in prison for failing to provide assistance to a person injured in a traffic accident, so he was sentenced to a single sentence of five months in prison, which he will serve in residential premises.
A prison sentence of one to eight years is provided for that offense, while failure to provide assistance is punishable by a fine or up to two years in prison.
The prosecution, as well as the court, decided that Brajović should serve his sentence in house arrest, given that he is a family man, the father of two children, and that he has no previous convictions.
It is stated that 13 days spent in custody will be deducted from his sentence.
Brajović is accused of hitting a girl with the front part of his car and causing her serious bodily injuries on December 7 last year, at the pedestrian crossing on Cetinjska put.
He is also accused of running away from the scene of the accident after hitting the child.
In the indictment, it is written that at that time he had over two parts per thousand of alcohol in his blood.
According to "Vijesti" information, the girl came out of the coma and is now fine.
The girl and her family did not attend the confirmation of the settlement in the Basic Court in Podgorica, and in this case, the injured parties have the right to appeal the plea agreement.
