The family of convict Jovica Zindović has been able to dispose of the property since yesterday, as it was established that it was acquired legally.
The High Court in Bijelo Polje canceled the measure of securing the ban on the disposal and use of immovable property of a person convicted of murder, respecting the appeal of Zindović's minor son and his legal representative, lawyer Stefan Jokić.
That court previously accepted the proposal of the state prosecutor's office for the temporary confiscation of property acquired through criminal activity, which Serbia sent in mid-January.
There was no other evidence that could in any way cast doubt on the statements of witnesses and written evidence, therefore the court came to the conclusion that, bearing in mind the price for which this object was purchased (business premises in Mojkovac), that its the value is clearly not in proportion to the legal income that the accused Zindović had in 2014", says the decision of the High Court
"The panel found that there is not enough evidence of the existence of a well-founded suspicion that the property benefit for which the temporary security measure was determined was acquired through criminal activity. This is due to the fact that when it comes to residential premises in Podgorica, which the minor son acquired from Anika Zindović's legal predecessor by contract, and which she acquired through a sales contract concluded for the seller MS, at a price of 100.000 euros, was acquired in the opinion of this court in a legal way, because the money for the purchase was secured from the sale of an apartment in Pljevlje for 60.000 euros and 40.000 from the savings of her brother Nikša Lončar's loan, whose statement was fully confirmed, and those circumstances were confirmed by the content of the statements of the witnesses Čed Vuković and Anika Zindović , Violeta Zindović, Branko and Stanka Zindović, and the content of the written evidence to which the court gave full credence", it is written in the explanation of the decision of the High Court.
Also, the court found that the residential area in Mojkovac, worth 10 thousand euros, was acquired legally, and the same applies to the orchards and meadows that he bought from his father for 22.000 euros: "It was established that this real estate was acquired in 2014 when Zindović was in custody".
Zindović was sentenced to 15 years in prison for the murder of Luka Popović in Žabljak in 2013. Two years later, he escaped from prison, and was arrested the following July in Belgrade with a kilogram of cocaine, weapons and 82.000 euros.
