In the continuation of the trial of the former mayor of Podgorica, Miomir Mugoša, his defense attorneys Mitar Mugoša and Predrag Đolević proposed to the court a new expert opinion, which will be conducted by the Institute of Expertise of the University of Montenegro, in order to determine the price of a square meter of land at the Old Airport, which the capital city sold to Customs. at a price of 165 euros.
After, before the special council of Judge Vesna Pean in the High Court in Podgorica, the defense attorneys pointed out numerous objections to the findings and opinions of experts from the construction and economic and financial professions, Vukašin Đuričković and Milenko Popović, expert Đuričković asked the court for a record in order to testify with his colleague on remarks.
Lawyer Mitar Mugoša emphasized that the experts neither in the basic nor in the supplementary report answered what the market price of a square meter of land at the Old Airport is.
"In the basic and supplementary findings, they listed four prices, which ranged from the first price of 927,79 euros per square meter, then 1.186,42 euros, then 384 euros and 88 euros. The experts did not apply the legally recognized methodology in Montenegro. Thus, expert witness Đuričković states that everything that is done in Montenegro in terms of determining the market price is illegal, and only their finding is legal. Simply unbelievable. In the conclusion of the Government of Montenegro, it is stated that (quote) "In the Main the city of Podgorica is selling real estate land KO 857,02 PG 734, with an area of 3 square meters at a price of 2.997 euros, and the stated price was determined according to the estimate of the "Real Estate Administration of Montenegro". We wonder what the experts did. They were an expert on the fog in this case," said lawyer Mugoš.
He added that, in the formal and legal sense, three findings should have been made, a surveyor's, a construction one, and then only at the end an economic-financial expert opinion, which was not done in this case.
The defense attorney believes that the experts use fantastic figures about prices that have never been realized, nor realized.
"The subject of the legal transaction between the Capital City as an institution and "Customs" is the sale of land, not residential space. This expert gave a different expert opinion in the restitution procedure - return of land, when he stated that the price per square meter of land is 56 euros. According to that logic, even and if this price was 100% lower than the market price, it would be significantly lower than 165 euros," concluded lawyer Mugoš.
Attorney Đolević referred to the part of the findings in which the experts state that the price per square meter of the planned space in 2007 ranged from 2.000 to 2.800 euros.
"When estimating the price of a square meter of land, they took into account the planning documentation, the number of floors and the rest, assuming that it will be built that way. Nowhere in the law does it say that the specified number of floors must be built. This fact alone indicates that the price of one square meter of land is not can be determined on the basis of the planning documentation," Đolević said.
The defendant, Miomir Mugoša, stated that after the Capital City's agreement with the army of Serbia and Montenegro, "Normal Company" completed the plot and bought 56 square meters of land from the army at a price of 70 euros. The trial continues on October 10.
What does the indictment say?
The indictment states that Mugoša "from July 25, 2007 to May 8, 2012, as an official and public functionary - mayor, by exploiting his official position and exceeding his official authority, obtained benefits for others and caused damage to the Capital City." .
"Acting contrary to the official interests and the interests of the capital, namely the Law on Construction Land, contrary to the decision of the Municipal Assembly, he made a decision on August 30, 2007 to transfer the right to the land to the company "Carine" for 165 euros per square meter, by direct agreement," it says. in the indictment. In this way, it is added, he obtained a benefit of 6.723.194 euros for "Customs", and damage in the same amount to the Municipality of Podgorica.
