The executive director of the NGO Center for Women's Rights, Maja Raičević, wrote a letter today to the Supreme State Prosecutor Ivica Stanković, expecting his immediate reaction in order to prevent the current practice that allows prosecutors to avoid responsibility in a case such as the case of Jelena Krstić in Berane.
She reminded that today in the Basic Court in Berane, she attended the hearing in the case in which Muhamed Ramusović was accused of violent behavior and inflicting serious bodily injuries.
"It is incomprehensible that even after serious complaints about the behavior of ODT Berana towards the victim, the prosecutor Gorica Golubović was not exempted from this case, but appeared today as a representative of the prosecution, which is why at today's hearing the attorney of the victim, who was hired by the Center for Women's Rights, requested the exemption of the prosecutor, as well as all the prosecutors of ODT Berana", stated Raičević.
In the letter, Raičević reminds them that on December 11, the VDT informed them that the Commission for Reviewing Complaints about the Work of State Prosecutors and Heads of State Prosecutor's Offices has not yet made a decision in this case, "so we believe that the case should have been assigned to another ODT from this prosecution, while not all the facts stated by the injured party in the complaint that we submitted to you on November 15.11.2019, XNUMX, and which were also stated at today's main trial, are established."
"In addition to the above, the head of the Higher State Prosecutor's Office in Bielsko-Biała, Mirko Bulatović, stated in his statement to the media that "after reviewing the files created regarding the criminal responsibility of Muhamed Ramusović, and based on the detailed statement given in the conversation and in writing by the acting state prosecutor Gorica Golubović, he determined that there is no evidence that would point to the truth of the claims of the injured party, Jelena Krstić, in the sense that the prosecutor asked her to forgive the attack and deny her earlier statements." He also states that he "notified the Acting Supreme State Prosecutor Ivica Stanković" of his decision. writes Raičević.
She says that because of this, she believes that even a layman can conclude that it was not to be expected that evidence of inadequate treatment by the ODT would be found in the case files and notes that before making such an opinion, the head of the Bjelo Polska Higher State Prosecutor's Office did not interview the injured party, which was from of key importance for looking at all aspects of this case and understanding the sense of threat suffered during the interrogation by ODT Golubović and the defendant's lawyer.
"Therefore, we believe that the actions of the Higher State Prosecutor's Office in Bijelo Polje did not properly serve to establish the real facts in this case, but only to satisfy the form, after your urgency, and therefore we expect your immediate reaction in order to prevent the current practice that allows prosecutors to avoid responsibility in such cases," concluded the director of the NGO Center for Women's Rights, Maja Raičević, in a letter to the acting VDT Ivica Stanković.
Earlier today, at the hearing in the Basic Court in Berane, Jelena Krstić's lawyer, Srđan Lješković, requested the exemption of the basic state prosecutor Gorica Golubović as well as the entire Basic Prosecutor's Office in Berane from the case against Muhamed Ramusović, who is accused of beating Krstić.
"Gone are the days when prosecutors could avoid responsibility in the case of inadequate treatment of the injured party, i.e. in this case the victim of violence. As you yourself notice, we have a situation where, as a representative of the injured party, I represent her interests and violated rights with the ODT. The situation is quite different as the attorney is forced to protect the injured party from ODT and the defendant, which is a total absurdity". said Lješković.
"Vijesti" was told by the Basic Court in Berane that in this case the complete case files are sent to the higher state prosecutor's office, which will decide on the request of Krstić's representative.
At today's hearing, the defendant's lawyer requested his release from custody, which, as the Basic Court said, will be decided by the criminal panel of that court in the coming days.
Ramusović is accused of beating a single mother, employee of JP Sports Center Berane, Jelena Krstić, at her workplace at the end of October. He is currently in custody and in the pre-trial detention center in Bjelopolje.
