Yesterday, the High Court suspended the proceedings against lawyers Goran Rodić, Siniša Gazivoda and Marija Radulović, who were accused by the Special State Prosecutor's Office of having committed a criminal offense - the creation of a criminal organization.
The decision of the panel of the High Court, however, confirmed the indictment of the same prosecution, which charged the lawyers with the commission of a criminal offense - attempted fraud. Attorney Branislav Lutovac, the defense attorney for the defendants, told "Vijesta" that he expected such a decision.
"For me, it was completely expected that the indictment was not confirmed for a criminal offense - creation of a criminal organization, and completely unexpected that it was confirmed for a criminal offense - attempted fraud. Considering the evidence presented by the Special Prosecutor's Office with the indictment, I calmly expect a trial for the criminal offense of attempted fraud, because I am convinced of the complete innocence of my clients".
As the spokeswoman of the High Court in Podgorica, Aida Muzurović, announced, the Special Prosecutor's Office can appeal to the Court of Appeal.

In the indictment brought by the SDT against Rodić and his colleagues Gazivoda and Radulović, they are accused of creating a criminal organization and attempting to defraud.
The indictment also states that, in the period from April 2016 to February 2017, Rodić formed a criminal organization, the goal of which was to commit crimes punishable by law with a prison sentence of four years or more, and for the purpose of obtaining illegal profits. and power.
It is also stated that the defendants, in order to implement the criminal plan, falsely presented the facts in order to mislead the A2A company and its representatives.
It is explained that Rodić allegedly presented to them that he was a friend from the army with Chief Special Prosecutor Milivoj Katnić and that by going out to dinner he could help the A2A company avoid criminal prosecution and that he allegedly asked for 600.000 euros for that.
At the hearing to examine the justification and legality of the indictment against the lawyer, Rodić then said that the act of the prosecution was illegal and explained that the prosecutor Stojanka Radović acted out of personal revenge and evil intent towards him.
At the end of the hearing, she replied that these were untruths.
Rodić said that it is only stated in general terms that he organized a criminal organization...
"In communication with A2A, I proposed three variants to solve the problem. In the legal opinion, I gave the A2A company the third option to accept that all illegally acquired property benefits in the amount of 6.500.000 euros be paid. I stated that in the negotiations with the prosecutor's office, I have a mandate to pay the total amount if I am hired. Therefore, to avoid criminal responsibility through negotiations. My fee for legal services would be €600.000 plus VAT. That was my offer to the A2A company," he said, stating that the prerequisite for everything was to hire him and for the negotiations with the prosecution to be successful.
Radulović said that for two and a half years her name has been unfoundedly exposed to public condemnation: "We are labeled as criminals. Why. Because that's what the prosecutor wanted".
We didn't get a decision, but we didn't do anything illegal either
Rodić, Gazivoda and Radulović announced yesterday that they had not received the decision of the High Court, which is why they do not know its content.
"We have not received the decision of the High Court, so we do not know its content and the reasons for it. However, at the hearing, we pointed out in detail all the groundlessness of the indictment, because we did not do anything illegal in our business relationship with the A2A company. This was confirmed during the investigation by all representatives of this company with whom we were in contact," the lawyer's statement reads.
