After the Court of Appeal on March 4 accepted the appeals of the defenders of the fugitive businessman and president of the Atlas Group, Duško Knežević, the Higher Court in Podgorica, in its decision in the case known as "Aerodrom", rejected as unfounded the proposal of the Special State Prosecutor's Office to try Knežević in absentia. , it was announced from the Atlas Group.
"Accepting the remarks and instructions of the Appellate Court of Montenegro, the Higher Court in Podgorica, in its decision rejecting the proposal of the Special State Prosecutor's Office for a trial in absentia, concluded what Mr. Knežević's defense emphasized in its appeals and during the proceedings, that Duško's stay alone Knežević abroad does not mean that he is unavailable to the state authorities. Because, in order for a person to be considered unavailable to the state authorities of Montenegro, even though it is known that he is in another country at a known address, one must first try to deliver a summons through international assistance. How in this particular case, the possibility of summoning through international legal aid was not used, and considering the fact that Mr. Knežević's address abroad is known, the conditions for a trial in absentia were not met in this particular case," said lawyer Nemanja Jolović.
