"Atlas banka" as a legal entity is charged with the criminal offense of abuse of position in business operations through incitement.
"From the defense of the defendants Nikolić and Zečević, and the testimony of the witnesses Danil Orlandić, Vesna Ječmenica and Milica Ivanović, it indisputably follows that the deadline for the deposit in question expired on August 11, 2018, and that the injured company "Aerodromi Crne Gore" repeatedly demanded and gave instructions to return the said funds in the amount of 3.000.000 euros to the transaction account of the damaged company after the deadline. But that didn't happen," states the prosecutor in the explanation of the indictment. It is added that from the e-mail communication and from the defense of Nikolić, it follows that these funds were not returned because the decision on this was made by the defendant Duško Knežević, who is in favor of keeping the funds and continuing to make them available to "Atlas Bank".
From the business and financial documentation and the opinion of the court expert from the economic and financial profession, it follows that three million euros were deposited with Atlas banka AD Podgorica on the basis of a contract on a fixed-term non-purpose deposit in the period from July 11, 2016 to August 11, 2017.
"Then, according to Annex I of the contract, the deadline was extended until August 11, 2018. After the expiration of the term, since they were not further termed, it should have been returned to the transaction account of the company "Aerodromi", which gave several instructions for the transfer, which did not happen, but when the temporary administration was introduced on December 07, 2018 ., and the temporary suspension of payment of obligations in Atlas Bank - when the disposal of those funds was limited, they were returned to the transaction account of the damaged company "Aerodromi", when the company could not dispose of those funds in their entirety", the explanation of the indictment states.
