The appellate court canceled the first-instance verdict in the "coup d'état" case, "Vijesti" confirmed.
Former general of the Gendarmerie of Serbia, Bratislav Dikić, will be released from prison in Spuz today, said his lawyer Dušan Jovović.
The "coup d'état" case was returned to the High Court in Podgorica, for a retrial before a completely changed panel.
"The panel canceled the first-instance verdict because in the process of its adoption and in the verdict itself, significant violations of the provisions of the criminal procedure were committed, and because of which neither the factual nor the legal conclusions in the first-instance verdict could be accepted, as in the report on the existence of the criminal offenses for which the accused were charged guilty, as well as in relation to the existence of their guilt for those acts," the Appellate Court said in a statement.
According to the first-instance verdict in this case, the leaders of the Democratic Front (DF) Andrija Mandić and Milan Knežević were sentenced to five years in prison each on May 9 last year.
The driver of the Democratic Front, Mihailo Čađenović, was then sentenced to one year and six months in prison.
Eduard Šišmakov was then sentenced to a single prison sentence of 15 years for the criminal offenses of creating a criminal organization and attempted terrorism, and Vladimir Popov to a single prison sentence of 12 years for the same criminal offences.
The accused Bratislav Dikić was then sentenced to a single sentence of eight years for the criminal offenses of attempted terrorism by aiding and abetting and creating a criminal organization, while Pedrag Bogićević was sentenced to seven years for the same criminal offences.
Nemanja Ristić was then sentenced to a single sentence of seven years in prison for the criminal offenses of attempted terrorism by aiding and abetting and creating a criminal organization, Srboljub Đorđević and Milan Dušić to one and a half years in prison each, Branka Milić to three years in prison, Dragan Maksić to one and nine years months of imprisonment. Kristina Hristić was sentenced to a suspended prison sentence.
