The police submitted a criminal complaint to the Special State Prosecutor's Office against Veljko Belivuk, Marko Miljković, JN and Ž.R. on suspicion of having killed Barane Damir Hodžić and Adis Spahić.
They are charged with having created a criminal organization, committing aggravated murder and aggravated murder by aiding and abetting.
The SDT announced that Belivuk and an unknown person are suspected of having formed a criminal organization in the second half of 2020, "whose goal is to commit criminal acts punishable by law with a prison sentence of four years or a heavier sentence, for acquisition of illegal profits and power."
"The operation of the criminal organization was planned for a long time with the application of precisely defined rules and internal control and discipline, and each member of the criminal organization had a predetermined task and role. In the operation of the criminal organization, the use of intimidation and violence was planned. The organizers are personally or through others members of the organization recruited persons to become members of the criminal organization, so in addition to the currently unknown persons, membership in the criminal organization was accepted by MM, JN and Ž.R." - it was announced from SDT.
They state that Belivuk, as an organizer, with the aim of realizing a criminal plan and committing an unspecified number of criminal acts of murder (from Article 143 of the Criminal Code of Montenegro), aggravated murder (from Article 144 of the Criminal Code of Montenegro), kidnapping (from Article 164 of the Criminal Code of Montenegro), decided for himself to plan commission of criminal acts, gives instructions and orders to the members of the criminal organization in the direction of the commission of criminal acts, to carry out the criminal acts for which the criminal organization was formed, while for the time being the NGO organizer determined for himself to determine the persons to be killed, provides material means for execution of a criminal offense, determines the time, place and manner of execution of criminal offences, collecting data on the movement of members of opposing criminal organizations that should be liquidated.
"Suspects MM and JN accepted to carry out the orders and instructions given directly to them by the organizers of the criminal organization, to carry out the criminal acts for which the criminal organization was created by themselves and with other members of the criminal organization, as well as to perform other actions assigned to them by organizers," added SDT.
Suspect Ž.R. he accepted, as they state, to carry out the orders and instructions of the organizers of the criminal organization that were directly given to him or transmitted by other members of the criminal organization, to provide logistical support to the organizers and members of the criminal organization, to provide housing facilities in which criminal acts will be committed is a criminal organization and was formed, provides assistance and prepares the execution of criminal acts of murder and kidnapping, communicates with persons who are determined to be deprived of their lives in order to bring them to the place where they will be killed, as well as to perform other actions determined by organizer.
"In the indicated manner, the suspect BV is reasonably suspected of having committed the criminal offense of creating a criminal organization from Article 401a paragraph 1 in connection with paragraph 6 of the Criminal Code of Montenegro and MM, Ž.R. and JN the criminal offense of creating a criminal organization from Article 401a paragraph 2 in connection with paragraphs 1 and 6 of the CCCG".
"At the same time, in order to realize the criminal plan, it is suspected that on October 14.10.2020, 144, in Danilovgrad, the suspects BV, MM and JN, by prior agreement and together, took the lives of several persons - the victims HD and SA, in which they were premeditated in the suspect Ž.R. assisted in the commission of the criminal offense of aggravated murder (from Article 14.10.2020 of the Criminal Code of Montenegro), by providing a residential facility - a house - in order to implement the criminal plan, and then entering into telephone communication with HD, who was determined to be killed by a criminal organization, and using the previously acquired trust, he asked the victims to come to the house he used in the village of Spuž in the municipality of Danilovgrad, so that they could see each other. entered Montenegro and came to the house of Ž.R., all with the aim of realizing the criminal plan to kill the injured parties SA and HD, so on October 15.00, XNUMX, at around XNUMX:XNUMX p.m., upon the arrival of the injured parties at the house of Ž.R., the suspect BV immediately deprived HD's life by firing a firearm and hitting him in the head area, causing injuries that resulted in his death," the statement said.
Suspects MM and JN at the same time, it is added, physically attacked the injured SA, tied him up, as well as RM who was with them in the company. On the same day SA was killed.
The damaged RM was taken to another location by others, for now unknown members of a criminal organization.
"The suspect BV informed other members of the criminal organization about the manner in which he committed the described criminal offense by means of a voice message via an encrypted mobile phone, and told them: 'Brother, Zemo and Hell, they all reacted well, that cannot be commented on at all, everyone got their own, 'Butcher' fell for me, 'Kratos' fell for 'brother-in-law', 'Hell' fell for M., the fact that 'Butcher' had an inlet and pulled, brother, no one could have expected that and that's not it could be changed and it can't be corrected, no way brother, I didn't want to risk it at all, we agreed that way, regardless of what you said in the group, if you see it and pull it, you'll shoot immediately. Brother, that's not the case why are we justifying ourselves'," they state from SDT.
After the serious murder to the detriment of HD and SA, NN members of the criminal organization removed the traces of the committed criminal acts by burying the bodies of HD and SA in an unknown location, and at the same time removed traces of the blood of the victims from the house by washing the walls of the interior of the house and changing floors, the prosecution pointed out. "In the indicated manner, BV, MM and JN committed the criminal offense of aggravated murder as co-perpetrators (from Article 144 point 8 in connection with Article 23 of the Criminal Code of Montenegro), while the suspect Ž.R. committed the criminal offense of aggravated murder committed by assisting ( from Article 143 point 8 in relation to Article 25 CC of Montenegro)".
"According to the data collected so far, the suspects are reasonably suspected of having committed the criminal acts charged against them, and criminal proceedings have been initiated against them for multiple murders. The evidence that has been collected up to the point of reasonable doubt indicates that the victims were first lured and then and liquidated by BV, MM and JN, and that after that the traces of the committed criminal acts were removed", concludes the announcement of the Special Prosecutor's Office.
