The Supreme Court of Montenegro extended the detention of a group suspected of planning an attack on police and judicial officials, including a judge of the High Court in Podgorica. Biljan Uskoković.
According to that act, detention was extended until mid-April Stefan Đukić, Stefan Mićić, Emil Tuzović, Aleksandar Raičević, Milan Brajović, Zoran Perović, Dušan Boljević, Dušan Dudić, To Nino Korac, Albin Salić, Bojan Lopičić i Branko Pejović.
The court's decision states that the extension of detention is justified because there is a well-founded suspicion that they have committed the criminal acts they are charged with.
The court concluded that the unhindered conduct of the criminal proceedings cannot be ensured by another milder measure and that, considering the criminal offense for which the suspects are based, the prevailing public interest is to ensure the conditions for the unhindered conduct of the criminal proceedings, rather than the defendants' right to freedom.
"The evidence gathered in the course of the investigation so far points to the conclusion of the existence of reasonable suspicion that in the course of 2020 and 2021, on the territory of Montenegro, the defendant S. Đ. (Đukić) and ET (Tuzović), together with another person who has not yet been identified, created a criminal organization whose goal is to commit criminal acts, and at the same time it was planned that the activities of the criminal organization exert influence on the political, executive, legislative and judicial authorities and that "According to the so far established suspicion, in addition to other unidentified persons, the accused MB, DD, ZP, NK, DB, AR, SM, AS, BP and BL also accepted membership in the criminal organization," states the order on the investigation of the Special of the State Prosecutor's Office of Montenegro from August 18, 2021.
It is alleged that Đukić and Tuzović, among other things, incited members of the criminal organization to commit crimes against life and limb to the detriment of the holders of judicial functions in Montenegro - judges and prosecutors, in order to delay criminal proceedings and avoid the responsibility of members of the criminal organization for the acts for which are accused...
"To coordinate preparatory actions, monitor the holders of judicial functions, plan and determine the time and place of attacks on holders of judicial functions in Montenegro, with the aim of inflicting serious physical injuries on judges and taking the lives of special prosecutors and police officers, in charge of solving serious crimes that was carried out by a criminal organization"...
It is added that they provided money in order to give bribes and promise bribes, in order to influence high state officials on the selection of suitable prosecutors in cases against members of a criminal organization and who will lead cases in the direction of acquittals, and that the prosecutors who have acted so far in those subjects should be relieved of their functions...
"From the case file, there is a well-founded suspicion that the defendant DD accepted membership in a criminal organization with the role of acting according to the orders and instructions of the organizers of the criminal organization, to directly commit the criminal acts for which the criminal organization was formed, and that in connection with the performance of official duties, physically attacked and inflicted serious physical injuries on a judge of the High Court in Podgorica, and in order to prevent her from performing her duties as a judge in a case against persons who are suspected to be organizers and members of a criminal organization," the court's decision reads.
It is added that from the analysis of the communication of the defendants via encrypted phones, it is established that there is a well-founded suspicion that Đukić asked Milan Brajović to monitor and observe the movements of the injured judge Uskoković, who is the president of the council in charge of the trial in the case in which he is the defendant...
"In that sense, he sent a text message via an encrypted mobile phone with the following content: 'Can we find out where this judge BU lives', and the message 'I want to break her, I don't want her to judge me', which the defendant MB accepted and for the sake of visual identification of the injured judge Biljana Uskoković requested from the defendant S. Đ. submitting a photo with her face, which he did".
It is stated that on March 5, 2021, Đukić sent the requested photo via an encrypted mobile phone, after which Brajović began observing the movements of the injured party, which he reported to him...
In the decision on the extension of custody, it is written that Đukić then issued instructions and an order to the defendant Dušan Dudić that one person "break the arms and legs" of the judge...
"'That bit is not allowed to go to court to try me', and the message 'I have to send her to recovery' and the message 'only on sick leave, another judge has to come to me then'", are some of the messages that Đukić sent, promising the executor that after that it will enable him to sell cocaine for himself and for the needs of the criminal organization.
Incitement to murder, bribery, assault on an official...
By order of the Special State Prosecutor's Office, it was decided to conduct an investigation against the defendants Đukić, Tuzović, Perović, Dudić, Brajović, Korać, Mićić, Raičević and Boljević, due to the well-founded suspicion that they committed the criminal offense of creating a criminal organization.
The order charges Đukić and Tuzović with reasonable suspicion that they have committed a criminal offense - murder by incitement.
Đukić is also accused of having committed the criminal offense of giving a bribe by means of incitement in connection with a criminal offense, unlawful influence by means of incitement, two criminal offenses of aggravated murder by means of incitement and the criminal offense of assault on an official in the performance of official duties by means of incitement in connection with a criminal offense grievous bodily harm by incitement.
By the order to expand the investigation, the defendant Dudić was also charged with the criminal offense of unauthorized production, possession and distribution of narcotic drugs.
