Former judge of the Basic Court in Pljevlja, lawyer Zorica Novaković, she was sentenced in the Basic Court in Bjelopolje to a single sentence of imprisonment for three years, for the extended criminal offense - fraud and the extended criminal offense - falsification of a document.
By the same decision, she is obliged to return the unlawfully acquired property benefit by committing the mentioned criminal acts.
According to the indictment, from 2013 to 2017, Novaković charged false expenses to the state in more than 20 cases, during which she illegally obtained property benefits in the amount of around 160.000 euros...
She did not admit the crime she was charged with.
According to the indictment, she submitted several proposals to public bailiffs from the Pljevlja area, with the use of falsified powers of attorney, for the execution of judgments in which the debtor is the state.
She is accused of falsely representing that in the period from 2013 to 2017, with the intention of obtaining material benefit for herself, court judgments and decisions of the Basic Court in Pljevlja, which have already been legally enforced once, are not final and enforceable...
"So, as a lawyer and representative of enforcement creditors, she submitted new proposals for permission to execute to public bailiffs in Pljevlja and the Basic Court in Podgorica. The lawyer created false documents - powers of attorney in which she stated that as a lawyer she was authorized to represent executive creditors - landlords, and to receive sums of money from the opposing party in their favor, personally signing on their behalf, with the intention of presenting the false documents as genuine." , the memorandum states.
It is added that, subsequently, she used false documents and powers of attorney as rights, attaching them to the resubmitted applications for the execution permit, misleading public bailiffs and executive judges of the Basic Court in Podgorica.
