Since the election of 11 judges now creates a quorum for holding the General Session, it is to be expected that they will immediately choose between two judges, and then submit the candidate's proposal to the Judicial Council for further selection procedures...
In order for one of the candidates to receive support, it is necessary to receive 2/3 of the votes of all judges in the Supreme Court.
"If we receive a candidate proposal, I will immediately schedule a session of the Judicial Council, where the interview will be conducted. We also had situations where we did not receive a proposal from the General Session of the Supreme Court, so now we are waiting", the Acting President of the Judicial Council told "Vijesta" Vesna Simović, Switzerland, explaining why the president of the highest judicial instance has not been elected so far.
That chair has been vacant since December 31, 2020, after Vesna Medenica, pressured by numerous accusations due to illegally spending the 3rd mandate, decided to leave.
The Judicial Council has several times unsuccessfully advertised for vacancies, and the closest to the seat of Medenica last year was the judge of that court. Miras Radovic, whose election did not pass at the session of the Judicial Council, because he did not have the required number of votes.
The procedure of Medenica's successor on August 3 was not possible because the Supreme Court was left without six judges by the decision of the Judicial Council on that day, whose mandate was terminated due to the fulfillment of the conditions for an old-age pension.
"This is a big day for the judiciary, because these are situations that are not experienced, that so many judges are elected in one day and that so many of them take the oath. I expect that we can now work at full capacity, it is a special and personal pleasure for me, but we will talk about that on Tuesday when you come to the court. I congratulate you all and I want you to continue working according to the law because that is the only way we can work and progress", said Vučković at the ceremony in the premises of the Judicial Council.
The president of the Judicial Council also congratulated the judges on their advancement in the judiciary: "I want you to be independent in your future work, because as you know, independence is a condition for the rule of law and that you do not perceive it as a personal privilege but as an obligation to serve only the Constitution, the law and other regulations and in the interest of those who come and seek justice from you", said Simović Zvicer.
11 newly elected judges of the Supreme Court were sworn in yesterday - Ranko Vukić, Tatjana Ljujic, Zoran Scepanovic, Jelena Čabarkapa, Milenka Žižić, Nevenka Popović, Seka Piletić, Marijana Pavićević, Katarina Đurđić, Vojin Lazović i Snezana Vukcevic.
At the ceremony in the premises of the Judicial Council, six newly elected judges of the Court of Appeal took their oaths Ana Vuković, Predrag Tabaš, Vesna Moštrokol, Evica Durutović, Danijela Vukčević i Diana Radulović.
The president of the Court for minor offenses in Budva also took the oath Marko Đukanović.
