The verdict of the Basic Court of Kotor according to which the owner of the hotel "Avala", the company "Beppler & Jacobson Montenegro" financed and built the disputed premises of the casino, while the tenant, the company "Kazino Avala" (Casino Avala), only carried out adaptation works, is not legally binding.
This was announced to Vijesti by the legal team of Casino Avalo, who responded to claims that forced eviction from the casino premises is expected.
"An appeal has been filed and the appeals have yet to be decided before the High Court in Podgorica. Beppler & Jacobson in the statement also refers to the finding of the geodetic expert (allegedly the judge explained it) which is not true. That finding, which does not suit Beppler at all, and the first-instance court did not value it at all, just as it did not value the other expert opinion of the construction profession. Nor did it give reasons why it might not have accepted them," writes Kazin Avala's legal team in its response.
The legal team states that they are ending any further controversy on this issue, and that everything they had to say was stated in the complaint.
