Whether the windmills on the Možura hill may have blown to the detriment of the Montenegrin budget will be known when the economic and financial experts finish the analysis of the documentation of the company "Možura wind park" in the business with the company "Shanghai Electric Power Engineering Montenegro LLC".
The experts, by order of the Basic State Prosecutor's Office in Podgorica, determine whether there was possible evasion of taxes and contributions during the business between "Možura Wind Park" and "Shanghai Electric Power Engineering Montenegro LLC", which was the contractor for the wind farm on the hill between Bar and Ulcinj.
"In the Basic State Prosecutor's Office, a criminal case was established on the basis of the correspondence and submitted files of the Special State Prosecutor's Office related to the affairs of the "Možura Wind Park", in order to assess the existence of elements of the criminal offense of tax and contribution evasion. The case is in the investigation phase. an expert of the appropriate profession", writes in the reply of the manager of ODT Podgorica Duško Milanović.
At the end of last year, SDT submitted case files to ODT Podgorica in order to investigate whether taxes and contributions were evaded in the business of two companies during 2017, when "Shanghai Electric Power Engineering Montenegro LLC" issued invoices for performed works and services to the company. Special prosecutors, by analyzing the data and documentation collected during the investigation in the Možura affair, came to the grounds of suspicion that the criminal offense of tax and contribution evasion under Art. 264 of the Criminal Code, which is why the case files were handed over to the ODT Podgorica for further proceedings and decision.
According to available data, the founder of "Shanghai Electric Power Engineering Montenegro LLC" is the Maltese company "SEP Engineering Malta CO. Ltd", whose director is Jian Zhang, and the authorized representatives are Jiao Wu and Dai Huriong.
Two subjects in SDT
In the Special State Prosecutor's Office, two investigations are underway regarding the works during the construction of the Možura wind power plant, and the cases are longer for the special prosecutor. Marija Raspopović i Sanja Jovićević.
SDT has been investigating for years whether the executive manager of the company "Adriatic capital advisory" Marko Vujović overpaid or perhaps charged twice for the consultancy services of the company "Možura wind park".
SDT is checking whether consulting services (obtaining various permits and reports) were done at all for "Možura wind park" and whether that work was worth 1.400.725 euros as stated in the business documentation.
In that separate criminal case, the documentation was given to the court expert in the economic and financial profession last year, but there is no information as to whether a finding was received.
In that case, statements were taken from responsible persons in "Možura Wind Park", who claimed that they paid 40.000 euros per month to the company "Adriatic Capital Advisory", and that there was nothing in dispute.
During the investigation, it was also checked who were the principals who, on the basis of consulting services, made payments to the "Adriatic capital advisory" account and who spent the money and in what way.
The owner of the company "Adriatic capital advisory" is hiding behind an offshore company from the Seychelles - "Spartans Global Holding INC".
Brothers Marko i Bojan Vujović they are cousins Branimir Gvozdenović, who in 2012, as the Minister of Sustainable Development and Tourism, issued key permits, after which the construction of a wind farm on the hill between Bar and Ulcinj was started...
The names of Vujović are found in numerous documents during the purchase and sale of the wind power plant.
Bojan Vujović, according to documents from the investigation in Malta, was the representative of the company "Cifidex Limited" and he signed the contract on the sale of the company "Možura Wind Park" to the company "Enemalta".
The business related to the purchase and sale of the wind power plant "Možura" in Malta was allegedly assessed as corrupt, because it is believed that corruption occurred through the company "Cifidex Limited" and other related transactions from 2015 and later, which were partly carried out through Montenegro. more high officials there.
Vujović previously announced that he was only a lawyer in that business, who provided legal and technical support in the project.
They have been scouting for five years
On October 19, 2017, the Special State Prosecutor's Office opened a case related to the construction of wind power plants (VE) on Možura, after it was announced in the media that Budvanin Vladimir Popovic and a citizen of Spain Karlas Cole Palou sued the company "Fersa Energia Renovables" and several companies from the BWP group, because they did not pay them the commission for the contracted work with the Government regarding the construction of the hydropower plant.
In that procedure, Popović and Palou claimed that they were deceived and pointed to the corruption of high-ranking state officials.
The Government of Montenegro in two convocations - the first on December 28, 2015, when the Prime Minister was Milo Djukanovic, and then on November 28, 2016, when he was at its head Dusko Markovic, adopted two reports in which she hid that the mysterious offshore company from the Seychelles "Cifidex limited", after paying 3,5 million euros, became the owner of the "Možura" project.
It is a company that is the focus of an international investigation into the murder of a Maltese investigative journalist Daphne Caruana Galicia, who was killed in a bomb attack on October 16, 2017, and for whose death the local businessman and the owner of the company "17 black" are accused Jorgen Feneca and two others believed to have been paid for the crime.
Galicia investigated whether Malta's top officials and related parties were involved in a corruption scheme during the purchase and construction of the "Možura Wind Park".
International research revealed the transactions of the Podgorica company of Đukanović's friend and business associate - a businessman Tomislav Čelebić with the company "Cifidex limited", which received money from the company from Dubai "17 Black", whose owner is the main suspect in the murder of the journalist.
The son of a murdered journalist, Matthew Caruana Galicia he previously told "Vijesti" that the then Prime Minister of Montenegro - Milo Đukanović was a key person from Montenegro whom his mother dealt with while investigating the "Možura" case, but also that she investigated his connections with the former Prime Minister of Malta Joseph Muscat and the ruling elite in Azerbaijan.
There is no answer as to whether they will reconsider the SDT's decision again
The Special State Prosecutor's Office did not reply to "Vijesta" that they reopened the investigation in the Možura case, because at the end of last year the team of prosecutors made a decision to dismiss the criminal charges against the two directors of "Možura Wind Park" - Kevin Chircopo and Jianchao Li, as well as the director of "Spice" Ronghe International limited" by Rajko Stanišić and authorized representative Yizhou Gui.
SDT, at the time it was headed by Milivoje Katnić, rejected the criminal complaint based on which it was investigated whether the company "Možura wind park" was legally denied almost seven million euros of input VAT.
The right to deduct input VAT, in the amount of EUR 6.942.447,87, was correctly declared based on the purchase of equipment in the business of "Možura wind park" and "Spice Ronghe International limited", the total value of which was over 40 million. For this reason, the SDT dismissed criminal charges against authorized persons for the criminal offense of abuse of position in business operations.
The SDT did not answer whether they ever, through international legal aid, asked the judicial authorities of Malta, Spain, Azerbaijan for documentation about that business again.
They did not answer whether they participated in any way, independently, or at the request of the competent authorities of Malta, in the investigation of the murder of the investigative journalist Dafna Caruana Galicia.
