Alternative Montenegro filed a criminal complaint against Tosčelik's management for, as they stated, millions in damage and destruction of property.
"As the basis for initiating the procedure, we cite the destruction of plants, their melting into scrap metal, the destruction of the infrastructure of the Ironworks, the theft of copper cables and everything valuable on the territory of that factory. This destroyed millions of assets of this factory, much higher than the value of the contract that this criminal group concluded with the Government of Montenegro on June 12.06.2012, XNUMX. year", the announcement states.
In the application, they requested that the management of Tosčelik, if they are in Montenegro, be ordered to be detained, that their documents be confiscated until the end of the investigation and that the state assessor perform an assessment of the damage.
They reminded that the Investment Agreement clearly defines the investor's obligations, such as maintaining production with at least 550 workers (250 permanent employees) at all times, investing in production and maintaining facilities in the condition in which they were found.
"In the meantime, formally and legally until the contractual obligations were fulfilled, the buildings, the land and everything on them belonged to the state of Montenegro. The aforementioned criminal group did not invest in production and buildings, part of the buildings were melted down and destroyed, and the obligations regarding the maintenance of production remained unfulfilled This caused millions of dollars in damage to the state. The objects that were melted down into scrap metal were worth more than the total value of the contract concluded with this criminal group. The current value of the Nikšić Railway Company is incomparably lower than what it had on the day the contract was signed, and the decline its value has nothing to do with the decline in the value of industrial facilities and the decline in the value of the land. Thus, the obligations of this criminal group remained unfulfilled. It is clear that on the one hand there was no intention to fulfill this contract," according to Alternative's lawsuit.
