The Parliamentary Committee for the Political System, Judiciary and Administration has decided that tomorrow, December 30, 2022, it will announce a public call for the election of three members of the Judicial Council from among distinguished lawyers.
This is the second invitation of the parent Board this year, after the Assembly on September 20 elected only Radoj Korać as a member of the Judicial Council from the quota of distinguished lawyers.
As written in the decision of the Board, which is signed by President Momo Koprivica, a person who meets the conditions prescribed by Article 16 paragraph 1 of the Law on the Judicial Council and Judges can be elected as a member of the Judicial Council from among distinguished lawyers.
"That he has fifteen years of work experience in legal affairs, enjoys personal and professional reputation and that he has not been convicted of criminal acts that make judges unworthy to perform judicial functions in accordance with the Law," the invitation states.
Applications for the Public Call with documentation are submitted in a sealed envelope to the Assembly's office or by mail, and the deadline for registering candidates is 15 days from the date of the public call. In accordance with the Law on the Judicial Council and Judges, the list of registered candidates will be published on the website of the Assembly and will be available to the public for at least ten days from the date of publication.
At the end of May of this year, the Committee for Political System, Judiciary and Public Administration announced a public call for the election of four distinguished lawyers in the SS, and as many as 35 candidates applied for that call.
During the summer, the board held several days of consultative hearings, and by the decision of the members, four candidates were chosen - professor Korać, lawyer from Bijelo Polje Fikret Kurgaš, lawyer Dragan Šoć and professor of the Faculty of Law Nebojsa Vučinić.
That the selection of members of the SS, even before the announcement of the public invitation, was a matter of political trade, was clear even before the Parliamentary Committee issued a public advertisement when "Vijesti" announced that professors Korać and Vučinić as well as lawyer Šoć were the most serious candidates for filling that position. bodies from the ranks of distinguished lawyers.
After that election failed, the competent working body, in accordance with Article 16a of the Law on the Judicial Council and Judges, was obliged to announce a new public invitation after the expiration of two months, until the full selection of the members of the Judicial Council from among distinguished lawyers.
In the Judicial Council, the 3rd mandate is now largely spent by three distinguished lawyers - president Vesna Simović Zvicer, Dobrica Šljivančanin and Loro Markić, who were elected to these positions in 2014, but after the legal change in 2018, they are allowed to hold that position all the time. until the election of new members of the Judicial Council from among distinguished lawyers.
