The Center for Civil Liberties (CEGAS) welcomed today's decision of the Prosecutorial Council to announce a call for an acting Supreme State Prosecutor. They also appealed for the election of the VDT for a full term as soon as possible
"The fact that today at the session of the Prosecutorial Council (TS) by a majority of votes (six members 'for' and five 'against') supported the proposal for the publication of a (public) call for candidates interested in the position of Acting Associate of the Supreme State Prosecutor (VDT), legally obligates the choice of any of the candidates, just as it was the case with the current acting VDT. In order to establish good practice and transparency, and until that choice is precisely defined by law, for two years in a row an invitation to candidates, which will not be called 'public', because it essentially has a consultative character. Regardless of the initiative sent to the Parliament and the Government by the majority of members of the TS, in the hope of amending the Law on the State Prosecutor's Office, in the part of extending the mandate of the acting VDT , the call for interested candidates for that position will be published again. By not electing the VDT, the TS is in a significantly less favorable position in terms of the chairperson, and then the continuous work of the new composition of the TS is disrupted," CEGAS announced.
They add that the amendment of the Law on the State Prosecutor's Office cannot happen in such a short period of time, that is, before the end of the mandate of the current acting VDT.
"It is also inappropriate from the point of view of the way to amend any law, with an emphasis on the Law on the State Prosecutor's Office, which must undergo numerous changes, but only and exclusively through public discussion, constructive dialogue, as well as the participation of experts and interested public", CEGAS added. -a.
"Even today at the session of the TS from the managers of the ODT Bar, Ulcinj and the deputy manager of Cetinje, it was possible to hear about numerous problems of the prosecutor's office - in terms of space, technical, security, but also professional, that there are not enough prosecutors, advisors and officials. Additionally, the fact that the VDT has not been appointed to date is one of the key problems for the progress of this institution," the announcement concludes.
