Podgorica policeman Pavle Milutinović is suspected of illegally holding the now deceased head of the Metropolitanate of Montenegro and the Littoral for three and a half hours in June 2020 Amphilochia in custody.
This results from the investigation of the Basic State Prosecutor's Office in Podgorica, which charges Milutinović with the criminal offense of unlawful deprivation of liberty.
"In the Basic State Prosecutor's Office in Podgorica, after conducting evidentiary actions, a criminal case was established against the PM from Podgorica, an officer of the Police Administration - Security Center Podgorica, for the crime of unlawful deprivation of liberty, committed to the detriment of the now deceased. metropolitan Amfilohi", writes in the answers submitted to "Vijesta", which are signed by the head of the ODT Podgorica, the prosecutor Dusko Milanović.
On June 22, 2020, the Metropolitan of Amfilohije was invited to the building of the Security Center (CB), in order as a citizen to answer questions about the rally organized the day before, which violated the measures of the National Coordinating Body to combat the spread of the corona virus, as the prosecutor assessed at the time Nikola Boricic.
He entered the Podgorica police building at 11.14:XNUMX a.m., and his interrogation lasted six hours.
The legal representatives of the metropolitan previously said that the police explained to them that Boričić, every hour, asked additional questions by text message.
Only when the legal representatives of the head of the MCP submitted a complaint to the Prosecutor's Council, Boričić announced his reaction in which he claims that on that day, at 13.52:XNUMX p.m., he ordered the release of the metropolitan and that the Police Directorate is the address for questions - why he was detained for almost three and per hour.
From that institution, however, they do not answer - who, on the basis of what and on the basis of which law, ordered that Amfilohije be kept in the official premises from 13.52:17.14 p.m. to XNUMX:XNUMX p.m.
They do not answer who and on whose order sent additional questions via Viber, posing as prosecutor Boričić, nor whether anyone will be held accountable for that.
Coordinator of the human rights and justice program of the Civic Alliance Zoran Vujicic, previously told "Vijesta" that Boricic had to prosecute all the police officers who detained him in the premises of CB Podgorica after he ordered them to release him.
At the beginning of December 2022, the Parliamentary Committee for Political System, Justice and Defense adopted the report from the control hearing on the detention of Amfilohi in CB Podgorica, and one of the conclusions is "to finally find out the truth about who, how and why led to selective treatment authorities of the time in order to cover up the affair and conceal the perpetrators of criminal and other illegal acts".
The report was adopted by the votes of the parliamentary majority, and the opposition did not attend the session.
"The control hearing provided the opportunity for the public to be informed and learn that it was a matter of politically motivated revanchism and persecution of a religious dignitary during his fight for the protection of the constitutional rights of his religious community, which he led... It is likely that the police officers from certain persons had the order to act in this way, which needs to be clarified to the end through the actions of the competent prosecutor's office", is one of the conclusions of the parliamentary committee.
Then they stated that the government at that time did not have the due respect for Amfilohi.
"The board assessed that in the conditions of the unscrupulous persistence of the then current political authorities in achieving their goals, there was a lack of respect for the elderly, as well as an appropriate attitude towards proven authority based on values, thereby violating the dignity of the person as a protected constitutional value", emphasized is under evaluation.
"I have proof that I let him go"...
In mid-November 2022, at the session of the Committee for Political System, Judiciary and Administration, when the control hearing regarding the illegal detention of Amfilohi was held, the director of the Police Administration, Zoran Brđanin, announced that the prosecution should close the story.
Acting prosecutor in that case, Nikola Boričić, stated at the time that it was good that after almost two and a half years the truth should be known, indicating that on June 22, at 13:52 p.m., he declared that, as far as ODT was concerned, Amfilohije could be released to freedom.
"I have proof that I let him go, but I don't know what happened next. Why he was detained for three and a half hours is not a question for me," said Boričić at the time, adding that the main question is why no criminal charges were filed against the acting inspector.
