The Center for Civil Liberties (CEGAS) welcomed the initiative of the member of the Prosecutor's Council, Steve Muk, to submit to that body the documentation from the competent prosecutor's offices, both special and higher prosecutor's offices, in the part of the case concerning the problem of gravel exploitation, considering the importance of that issue, both in the judiciary and in the public.
"I am pleased by the fact that the proposal for the adoption of this issue, to be part of today's session, was unanimously accepted, which can give hope that such cases will be clarified to the best extent possible," announced CEGAS.
"Discussing the initiative of colleagues from Action for Human Rights, on the way of implementing the Strategy for the Investigation of War Crimes of the State Prosecutor's Office of Montenegro from 2021-2022, the members will consider in detail how they will contribute in terms of legal restrictions, due to the sensitivity of the procedures themselves ", they add.
According to CEGAS, the Prosecutor's Council discussed today whether it is obliged to examine the effectiveness of the investigation when deciding on complaints, and "opinions of the members were divided".
"In the case of 'Grujičić', two members of the Commission for decision-making on a complaint considered that the TS, i.e. the Commission for decision-making on a complaint, cannot deal with examining the effectiveness of the investigation, while the third member of the TS and the Commission considered that the effectiveness of the investigation should be dealt with, considering the Law on the State Prosecutor's Office, where it is clearly stipulated that the State Prosecutor's Office performs its function on the basis of the Constitution, laws and confirmed international treaties", CEGAS stated.
In that NGO, they believe that "all these TS dilemmas" are also due to the reason "the need to change the umbrella Law on the State Prosecutor's Office of Montenegro, which will monitor the compliance of secondary legal acts".
