Only Stevo Muk abstained.
This is what the Prosecutorial Council decided because seven members of that body voted for Begović to take over the management of the prosecutorial organization in the next six months.
Nikola Samardžić, Đurđina Nina Ivanović, Siniša Gazivoda, Filip Jovović, Miloš Vuksanović, Borivoje Đukanović and Bojan Božović voted for Begović.
Tatjana Begović is the new acting Supreme State Prosecutor
Member Siniša Gazivoda said that by submitting his resignation, the legal obstacle to Begović being appointed as acting VDT was removed.
"Taking into account ethical and professional qualities, I will vote for Tatjana Begović," said Gazivoda.
TS member Stevo Muk said that he will abstain from discussion and voting, because he believes that the fact that Begović has been performing the function of TS member with them for more than a year could be "against the spirit of the Law on the State Prosecutor's Office".
"That's why I think that the resignation during the session does not change the matter," said Muk.
And the distinguished lawyer Borivoje Đukanović said that he will vote for Begović with full confidence, knowing her human and professional qualities.
TS member Filip Jovović proposed that Tatjana Begović perform the function of acting VDT for the next six months.
He said that she can respond to this challenge in a high-quality manner due to her knowledge of criminal law matters.
Nikola Samardžić immediately proposed to end the 5th session of the TS, and then announced that the 6th session of that body would be opened soon with one point - the appointment of the acting VDT.
This was done in order to remove formal and legal obstacles so that Begović could be elected to a key position in prosecutorial organizations.
The deputy president of TS said that that body received the request for Begović's resignation.
TS stated the resignation unanimously.
This is probably an introduction so that one of the TS members would formally propose Begović for acting VDT.
TS member Sanja Jovićević was not present at the session because she requested an exemption on Monday.
With a delay of half an hour, the session of the TS continued, where Tatjana Begović was not present.
Whether Senior Prosecutor Tatjana Begović will be the new Acting Supreme State Prosecutor will be known today, when after 14:XNUMX p.m., the continuation of the session of the Prosecutorial Council is expected to continue, at which Maja Jovanović's successor at the top of the prosecutorial organization should be determined.
This morning, "Vijesti" received information from several sources in the judiciary that Begović is the most serious candidate for the acting position because her name was the most acceptable to the majority of the members of the Prosecutor's Council, who during the break of the session agreed on who would be from the list of 43 names of Montenegrin prosecutors, who have over 15 years of prosecutorial experience, Jovanović could inherit.
In addition to Begović, the head of the Basic State Prosecutor's Office, Duško Milanović, had a good chance, who was mentioned as a possible replacement in the chair of the acting VDT.
Begović, as expected, will submit a written resignation from membership in that body to the Prosecutor's Council, but it is a matter of interpretation by members of the TS whether or not she will have a legal restriction on being elected to lead the prosecutor's organization in an acting mandate for the next six months, since this is not the new session of that body is just a continuation of the session from Monday, February 6 of this year.
On Monday, the TS did not have the majority to appoint one of the two candidates, who applied to the TS's informal public call for acting VDT.
Lawyer Milorad Miško Marković lacked a vote, while special prosecutor Sanja Jovićević received support from only prosecutors Begović and Đurđina Nina Ivanović, while the others abstained precisely because she did not resign from membership in the Prosecutor's Council.
Maja Jovanović, who managed the prosecutor's organization in acting capacity for two terms of half a year each, was terminated on Monday.
The Prosecutor's Office has been in acting status since October 2019, and the Prosecutorial Council is simultaneously conducting an election procedure to determine the proposal for the Supreme State Prosecutor for a full term.
