At the same time, I hope that the deputies in the Assembly will elect the VDT in full capacity as soon as possible", the new Acting Supreme State Prosecutor (VDT) told "Vijesti" Tatjana Begović.
The decision for Begović to take over the VDT was made by the Prosecutor's Council, which decided by the majority of votes in that body that the senior state prosecutor in Podgorica, and until today a member of that body, will take over the management of the prosecutor's organization in the next six months.
Seven members of that body voted for Begović to take over the chair of acting VDT, while he is a respected lawyer Stevo Muk was restrained. He explained that such a decision is against the spirit of the Law on the State Prosecutor's Office, because Begović was also a member of the TS in the past year.
"The Law on the State Prosecutor's Office clearly stipulates that a member of the Prosecutor's Council from the ranks of state prosecutors cannot be elected to the position of manager or advance during the term of office in the TS. I believe that even in the previous case of candidacy Sanje Jovicević, as well as in today's candidacy of Tanja Begović, there are no procedural, legal conditions to be appointed as Acting Supreme State Prosecutor", Muk repeated after the TS session.
Prosecutors voted for Begović Nikola Samardzic, Đurđina Nina Ivanovic and eminent lawyers Siniša Gazivoda, Filip Jovović, Miloš Vuksanović, Borivoje Đukanović and Bojan Božović.
RESIGNATION THEN VOTE
As "Vijesti" announced before the continuation of the TS session, Begović submitted her resignation from membership in the Prosecutor's Council to that body during the day, because her name was the most acceptable to all members of the TS to be the successor. Maje Jovanovic in the top of the VDT.
The fifth session of the Prosecutor's Council first continued at 14 p.m., and at the very start Begović's resignation as a member of the TS was noted. The session was then formally adjourned.
Deputy President of TS Nikola Samardzic he scheduled a new one immediately after the confirmation of Begović's resignation.
At the very beginning, a member of TS Philip Jovovich he suggested that Begović take over the acting mandate.
"I believe that she can respond to this challenge in a high-quality way because of her knowledge of criminal-legal matters, but also because of her human and professional qualities," said Jovović.
And the distinguished lawyer Borivoje Đukanović said that he will vote for Begović with full confidence, knowing her human and professional qualities.
Gazivoda emphasized that Begović "by submitting her resignation removed the legal obstacles to her being appointed as acting VDT".
"Taking into account ethical and professional qualities, I will vote for Tatjana Begović," Gazivoda said briefly.
The session at which Maja Jovanović's successor was elected began on Monday, February 6 this year, when none of the two candidates who responded to the informal public invitation of the TS received the necessary support in that body.
Lawyer Milorad Miško Marković was unable to vote, while prosecutors Begović and Ivanović voted for special prosecutor Sanja Jovićević that day, while the other members abstained mainly because she did not resign from membership in the TS before the session.
The prosecutor's organization has been in acting status since October 2019, and the Prosecutor's Council is simultaneously conducting the election process for the VDT in full term.
