The trial of the accused criminal group Stefan Đukić and Emil Tuzović, who were accused by the special state prosecutor's indictment of preparing the murders of judges, prosecutors and police officials, was supposed to continue in the High Court in Podgorica today. The defendants are scheduled to present their defense.
The main hearing was postponed because one of the defendants is being treated in a hospital in Dobrota.
The court received a letter from the "Dobrota" Special Hospital, which states that one of the defendants has been transferred from prison custody to the court ward due to his mental condition, and that he is unable to follow the court proceedings.
The president of the special council of judges, Zoran Radović, announced that the special state prosecution submitted to the court the files it received from the General Court of Ukraine for the accused Stefan Đukić and Emil Tuzović, who are in a Ukrainian prison. The judge ordered that the received documentation be translated.
The accused criminal group of the accused Stefan Đukić and Emil Tuzović planned to attack and beat the High Court judge Biljana Uskoković, as well as the chief special prosecutor Milivoj Katnić and his colleague prosecutor Saša Čađenović.
In addition to Tuzović and Đukić, Zoran Perović, Dušan Dudić, Milan Brajović, Nino Korać, Stefan Mićić, Aleksandar Raičević, Dušan Boljević, Albin R. Salić, Branko D. Pejanović, Haris Tuzović, Goran Milašinović and Bojan G. Lopičić are also accused.
It is stated in the indictment that the defendant Stefan Đukić demanded from Brajović and Zoran Perović to follow Nikola Dedaj in order to kill him in a cruel and insidious manner. Đukić is accused of being Brajović's boss that as soon as the new government dismisses the head of the Police Directorate, Zoran Lazović, and police officers Petar Lazović and Ivan Đoković, as well as the chief special prosecutor Milivoj Katnić and Saša Čađenović, and after their dismissal, immediately kill them in a cruel and insidious manner . The indictment adds that the defendant Đukić sent the accused Brajović photos of judge Biljana Uskoković, then followed her, which Brajović accepted.
In the decision of the Court of Appeal, it was stated that the defendants are reasonably suspected of having committed the criminal acts charged against them by the indictment of the Special State Prosecutor's Office of Montenegro, i.e. that in the course of 2020 and beyond, the defendants Stefan Đukić and Emil Tuzović, together with others by a so far unidentified person, created a criminal organization whose goal is to use violence and intimidation, and at the same time it is planned to influence the political, executive, legislative and judicial authorities in the operation of the criminal organization.
"The defendant Emil Tuzović decided for himself and in agreement with the defendant Đukić, that he plans in the future to commit the criminal acts for which the criminal organization was created, to recruit persons through other members of the criminal organization to become members of the criminal organization, to incite members of the criminal organization to commit crimes crimes against life and body to the detriment of the holders of judicial functions in Montenegro - judges and prosecutors, in order to delay criminal proceedings and avoid the responsibility of members of a criminal organization for the crimes for which they are accused. Then to coordinate preparatory actions, monitor the holders of judicial functions, plan and determine the time and place of attacks on holders of judicial functions in Montenegro, with the aim of inflicting serious physical injuries on judges and depriving the lives of special prosecutors and police officers, in charge of solving serious crimes that was carried out by a criminal organization," the decision reads.
It is further stated that the defendant Zoran Perović acts according to the orders and instructions of the organizer of the criminal organization of the defendant Stefan Đukić, that he establishes communication with the holders of the highest state positions in the executive branch, that, using his previous acquaintance and his real and assumed influence, he offers them money and other benefits in exchange for the influence of the holder of executive power on the dismissal and election of holders of judicial functions - judges and prosecutors, who in court proceedings against the organizers and members of a criminal organization would deliver acquittals for crimes of aggravated murder and other crimes committed in an organized manner.
"By offering the holders of public functions of the executive power at least one million euros to remove the Chief Special Prosecutor Milivoj Katnić and the Special Prosecutor Saša Čađenović, who initiated, led and filed charges against the organizers of the criminal organization," the decision reads.
