Nikšić: Terić and Vojinović sentenced to one year probation each

"It is sad that Boris Miljanić, the owner of 'Sabb security', joined the criminal prosecution, considering that he is aware and knows that he threw a sick and weak man out on the street. He achieved nothing, and it was humane and moral to wait for the epilogue of the others disputes, and only then take further steps," said Terić

The director of the National Kitchen from Nikšić and the NGO "Izvor života" Konstantina Vojinović, and her fellow citizen Vaso Terić, were each sentenced to one year of probation (Vojinović to two months in prison, and Terić to three, if they commit a criminal offense within a year). They were charged with the criminal offense of attacking someone else's property.

In April of last year, Terić was evicted from a shack in the Rastoci settlement in Nikšić, where he lived for years, because the land on which the shacks are located, where 11 families are located, was sold to the company "Sabb security" from Herceg Novi.

The residents of the barracks filed complaints about the announced eviction, and Terić did not do so because he had no money. After moving out and his intention to sleep on the street, Vojinović returned Terić to a 30-square-meter apartment.

The two, as they said, will not appeal the verdict, and they are grateful to judge Sava Mušikuć for taking their previous lack of conviction, poor financial condition and Terić's remorse for the crime as a mitigating circumstance.

He recalled that he was evicted with the help of a public bailiff and the assistance of the police, that Vojinović did not allow him to spend the night on the street, and that he had no income until the eviction.

"After that, the Center for Social Work provided me with an income of 68 euros. Humane people collected the money and made it possible for me to join the lawsuit challenging our evictions without any rights. We all moved into those apartments with the approval of the then administration and invested we are the means for the maintenance of those facilities, so we are accordingly demanding our rights as former employees of Prvobroc," said Terić.

Former workers of the Prvoborac construction company have been living in the barracks, which are temporary facilities, since 1994. They received eviction notices last year, because as of August 31, 2020, the owner of the land of almost six thousand square meters is the company Sab sekjuriti from Herceg Novi.

According to the residents of the barracks, the aforementioned company entered into a preliminary purchase agreement with Agrologistika two years ago.

The families moved into the temporary facilities on the basis of a verbal agreement with the management of Prvoborec, which was declared bankrupt not long after. The barracks, which served as dormitories for the workers from Kosovo, were in extremely bad condition, so the tenants had to invest money to make them more tidy.

They repeatedly appealed to Novi Prvoborc, the legal successor of the company that was in bankruptcy and which, based on the right of use, acquired the right of ownership over the land in 2020, to issue them a decision based on which they can live in temporary buildings.

Vojinović pointed out that she is glad that Terić, thanks to humane people, has the same opportunity, as all the tenants in those barracks, to fight for their rights, convinced that this will happen.

"I hope that justice will be served regarding the threats that I received during Vas's re-immigration. I also hope that the owner of the company, Boris Miljanić, will personally call me and convey to me all the messages he has for me, which he sends to me through other persons," said Vojinović.

She recalled that her single mother and she were also forcibly evicted and that she was less than three years old at the time.

"I will always fight for those people who violently end up on the street, or the law is selectively applied to them. I don't think I can be above the law, but I am always ready to proudly bear the punishment for such a crime," said Vojinović and thanked everyone who offered her help and support during the mentioned case.
