The Prosecutor's Council will ask the Basic State Prosecutor's Office in Podgorica to provide them with information on the cases that were formed during 2018, based on reports from citizens and non-governmental organizations about the alleged forgery of signatures of support for candidates during the last election race for the president of the state.
Member of TS Siniša Gazivoda he demanded that this body should take the initiative to address the Podgorica Administrative Office, because this issue has been raised in the current presidential campaign.
"I think we should also deal with issues that are important to society, and now we have a situation that is again a current story regarding the collection of signatures. At this moment, I would not open new applications, because the election process is ongoing, so it would be politically sensitive until that process is finished. However, at the same time, we learned from the media that even during the 2018 elections, we had decisions where a problematic issue was raised - that it had been decided on for five years, and according to what the NGO that submitted the applications announced, a relative statute of limitations had set in because no actions had been taken." , suggested Gazivoda.
He stated that answers should be sought from the ODT Podgorica - how many cases were formed, when the first action was taken in those cases and when the last action was taken, and which refer to reports for the alleged misuse of signatures during the 2018 presidential campaign.
Representative of the Ministry of Justice Bojan Božović he said that he was "defeated that time is allowed to pass in the way it is"...
"I think it's good to look at all those cases, see if there were any omissions, and send a message somewhere - that it wouldn't be good if some similar things happen again," he said.
Acting VDT Tatjana Begović she informed the TS members that a working group was formed, which should collect all relevant information, in order to finally solve the problem of securing the headquarters of the prosecution offices.
"Since 2015, funds have been requested for the formation of the Security Service, and the budget only provided for this year part of the money, with the filling of 11 out of 23 workplaces, as it was foreseen by the rulebook from 2018. That is not enough. I must inform you that four prosecutor's offices do not have any security, and the other one, which is guarded by the UP without a legal basis, is provided in an insufficient way and without any technical means", said Begović.
The head of the Kolašin ODT, Maja Šćepanović, informed the members of the TS with the results of the work, stressing that he has great challenges in his work - because he is the only prosecutor and at the same time the head of that prosecution.
"It's a lot of work because there are no interns or advisors in Kolašin. Since I don't have an advisor, I'm in a situation where I deal with cases according to priorities. In my daily work, I am either at trials or at hearings or in communication with UP officials. The police force is severely understaffed, they do not have a chief of the criminal police, nor an inspector for economic crime. Recently, during an inspection tour, I found that 23 large construction sites are currently active in Kolašin. I was trying to get someone's help, to determine how things are done there, who is doing it, whether there are possible abuses. At almost every construction site, we found workers with fake health permits. I can imagine what's in there," Šćepanović said.
She emphasized that there is an increase in the crime of domestic violence in that city, and that she had as many as three custody cases in seven days.
Member of TS Stevo Muk he stated that "there is an unhappy judicial situation in Kolašin".
The plaintiffs are asking for a 70 percent reduction in their employment
Special Prosecutor Sanja Jovićević and Prosecutor of the Supreme State Prosecutor's Office Đurđina Nina Ivanović asked the Prosecutor's Council to allow them to spend 33 percent of their working time working within the Prosecutor's Council, based on Article 70 of the Law on the State Prosecutor's Office.
The legal solution stipulates that TS members from the ranks of state prosecutors can, due to the performance of duties in that body, and based on the decision of the TS, work up to 70% of their working time in the Prosecutor's Council and that their workload is reduced by that amount - prosecutor.
After hearing Jovićević's request, the members of the TS from the ranks of respected lawyers expressed a dilemma regarding whether the request should be granted, especially since they referred three prosecutors to the SDT for assistance since June of last year.
"We can't give up on the prosecutors," Muk said.
TS will ask GST Vladimir Novović and acting VDT for a statement based on which they will make a decision at the next session.
