The Special State Prosecutor's Office filed an indictment against the defendants Miloš and Vesna Medenica, Darko Lalović, Vasilij Petrović, Bojana i Marko Popović, Milice Vlahović Milosavljević, Marko Vučinić, Milorad Medenica, Luke Bakoča, Petar Milutinović, Ivan Kovačević, Radomir Raičević, Marjana Bevenje, Steve Karanikić i Goran Jovanović i „Kopad CompanyDOO Nikšić, for the criminal offense of creating a criminal organization, the extended criminal offense of smuggling, the extended criminal offense of giving a bribe, accepting a bribe, unlawful influence and inducing unlawful influence, abuse of official position, unauthorized production, possession and distribution of narcotic drugs, enabling enjoyment of narcotic drugs, illegal possession of weapons and explosive substances, serious bodily injury and prevention of evidence.
The defendant Miloš Medenica is accused, among other things, of creating a criminal organization in 2019, the members of which were the defendant Vesna Medenica, nine defendants and a defendant legal entity, with the aim of smuggling cigarettes and illegal influence to the judicial authorities, and for the purpose of acquiring illegal profits and power, and that, in co-perpetration with the accused members of a criminal organization, evading the measures of customs supervision, from the Free Customs Zone of the port of Bar, he smuggled cigarettes into the customs territory of Montenegro, for the purpose of sale, with the help of a false documentation and giving bribes to the accused customs officials.
The defendant, Vesna Medenica, is accused of committing, in the period from 2019 to 2021, that, using her official position as president of the Supreme Court and her assumed influence, as a former president of that court, she would mediate certain civil cases that were led before the High Court in Podgorka and the Supreme Court of Montenegro ended in favor of the companies "Fab Live"And"Pipe Commerce", regardless of the factual situation, in which the defendant Miloš Medenica and certain members of the criminal organization helped her, and that the defendants Popovići and Petrović led her to illegal influence, and that a bribe was given for her mediation.
The defendant Vesna Medenica is accused of having, at the end of 2018 and the beginning of 2019, as the president of the Supreme Court of Montenegro, encouraged the defendant Milica Vlahović Milosvaljević, a judge of the Commercial Court of Montenegro, to abuse her official position in litigation, and contrary to the Law on enforcement and securing, adopt a temporary measure in favor By Rada Arsić, the godmother of the defendant Vesna Medenica, and his company, which severely violated the rights of the other litigant, the indictment states.
The defendant Vesna Medenica is also accused of mediating with Supreme Court judges in 2019, as president of the Supreme Court of Montenegro, using her official position, and in 2022, as former president of that court, using her social position and assumed influence. of Montenegro, i.e. the judges of the Basic Court in Herceg Novi, to perform official actions contrary to the Law on Judicial Council and Judges, i.e. the Law on Civil Procedure, and make a decision in the case in favor of the company "Carine".
The defendant Darko Lalović is accused of having, in 2020, used his official position as an employee of the Police Administration to mediate without authorization the purchase of narcotic drugs for the defendant Miloš Medenica, who is accused of giving the purchased drugs to others to enjoy, but also of kept a weapon in the house, the possession of which is prohibited for citizens, and carried it in a public place.
SDT believes that Miloš Medenica and his mother Vesna accepted a bribe, after she decided to use her judicial position to issue a verdict in favor of the company "Fab Live", which was sued by the company "Gugi Komerc".
The owners of "Fab Lajva", the defendants Marko Popović and Bojan Popović, as suspected by the SDT, accepted to pay 181.000 euros, equivalent in real estate, so that the verdict would be in their favor, and to the detriment of "Gugi Komerča", which by such decision of the Supreme court was damaged by 2,3 million euros.
