The trial of the defendants for planning the murders and monitoring the judge started again today in the High Court in Podgorica, before the special criminal panel presided over by judge Zoran Radović.
The defendants stuck to the defense they gave before the court in December 2022, in which they rejected the allegations of the indictment.
The defendant, Milan Brajović, also known as Mića, pleaded not guilty in the case in which Stefan Đukić and Emil Tuzović, by the indictment of the Special State Prosecutor's Office (SDT), were accused of preparing the murders of judges, prosecutors and police officials.
He again called the indictment a fantasy of the special prosecutor in order to make themselves victims.
The accused criminal group of accused Stefan Đukić and Emil Tuzović allegedly planned to attack and beat High Court judge Biljana Uskoković, as well as chief special prosecutor Milivoj Katnić and his colleague prosecutor Saša Čađenović.
"I spent the whole of 2020 serving my sentence in prison for the crime of minor bodily injury, until the end of November, and the prosecution accuses me of being the most active in monitoring judge Biljana Uskoković. The former special prosecutors staged this to make themselves victims and labeled me. Compared to the earlier statement from December 2020, a lot has changed. Today we have special prosecutor Saša Čađenović in custody, the top of the Police Administration is in custody, the prosecution was compromised at a session in the Parliament of Montenegro where they accused each other , and we also have another 100 police officers in the Police Department who use encrypted phones and allegedly used sky applications. We also have a CD recording that was made in the premises of the SDT, about putting a noose around someone's neck, I mean the accused Miloš Marković. We have a GST statement Katnić, who says that he found out about this work from the newspaper, and that he did not know about this data, with sky applications. I see that the evidence is the testimony of Saša Sinđelić, it is known where he is and he was questioned, but we know nothing about sky communications and applications . I hope that the current chief special prosecutor, Vladimir Novović, will not be blind and deaf, as he was when he was an investigating judge, when he was both blind and deaf when he sent abused boys to prison. I hope that Novović will show that SDT works according to the laws of Montenegro and show all politicians that we are guilty or innocent. I have full confidence in this council /judge Zoran Radović/, according to the laws of Montenegro, despite the politicians, those who knew about the Europol data published by Olivera Lakić, the same politicians who are involved in cigarette smuggling. I've been in prison for two years and I don't know why," said Brajović in his defense.
Answering the questions of special prosecutor Miroslav Turković, where did his family photos come from on Sky applications, the defendant Brajović said that they could have been "taken" from Facebook and posted there.
"I don't need to prove my innocence, but the prosecutor needs to prove my guilt, the base station where those photos were sent, and how I bought/paid for an encrypted phone. I don't know the accused Đukić and he couldn't have incited me to commit any crime." stated Brajović.
In addition to Tuzović and Đukić, Zoran Perović, Dušan Dudić, Milan Brajović, Nino Korać, Stefan Mićić, Aleksandar Raičević, Dušan Boljević, Albin R. Salić, Branko D. Pejanović, Haris Tuzović, Goran Milašinović and Bojan G. Lopičić are also accused.
Đukić is accused of being from Brajović, that as soon as the new government dismisses the head of the Police Directorate, Zoran Lazović, and police officers Petar Lazović and Ivan Đoković, as well as the chief special prosecutor Milivoj Katnić and Saša Čađenović, and after their dismissal, they are immediately and brutally killed way.
The indictment adds that the defendant Đukić sent the accused Brajović photos of judge Biljana Uskoković, then followed her, which Brajović accepted.
The defendant Nino Korać rejected the allegations of the indictment, while the defendant Stefan Micić said that he will defend himself by remaining silent and will not present a defense.
The defendant, Aleksandar Raičević, stated that he does not recognize the allegations in the indictment, that he is not a member of a criminal organization, and that he did not use an encrypted phone.
The defendant Dušan Boljević said that he had nothing to do with the criminal organization founded by Đukić and Emil Tuzović.
The accused Goran Milašinović, Bojan Lopičić and Haris Tuzović and Dušan Dudić rejected the allegations of the indictment.
In the decision of the Court of Appeal, it was stated that the defendants are reasonably suspected of having committed the criminal acts charged against them by the indictment of the Special State Prosecutor's Office of Montenegro, i.e. that in the course of 2020 and beyond, the defendants Stefan Đukić and Emil Tuzović, together with others by a so far unidentified person, created a criminal organization whose goal is to use violence and intimidation, and at the same time it is planned to influence the political, executive, legislative and judicial authorities in the operation of the criminal organization.
"The defendant Emil Tuzović decided for himself and in agreement with the defendant Đukić, that he plans in the future to commit the criminal acts for which the criminal organization was created, to recruit persons through other members of the criminal organization to become members of the criminal organization, to incite members of the criminal organization to commit crimes crimes against life and body to the detriment of holders of judicial functions in Montenegro - judges and prosecutors, in order to delay criminal proceedings and avoid the responsibility of members of a criminal organization for the acts for which they are accused. Then to coordinate preparatory actions, monitor judicial function holders, plan and determine the time and place of the attack on the holders of judicial functions in Montenegro, with the aim of inflicting serious physical injuries on the judges and taking the lives of special prosecutors and police officers, in charge of solving serious crimes committed by the criminal organization. The defendant Zoran Perović to act according to the orders and instructions of the organizers the criminal organization of the defendant Stefan Đukić, to establish communication with the holders of the highest state positions in the executive branch, to offer them money and other benefits in exchange for the influence of the holder of the executive branch on the dismissal and election of the holders of judicial positions, using his previous acquaintance and his real and assumed influence - judges and prosecutors, who would deliver acquittals in court proceedings against the organizers and members of the criminal organization for crimes of aggravated murder and other crimes committed in an organized manner. By offering at least one million euros to the holders of public functions of the executive power to dismiss Chief Special Prosecutor Milivoj Katnić and Special Prosecutor Saša Čađenović, who initiated, led and filed charges against the organizers of the criminal organization."

The President of the Special Council of Judges, Zoran Radović, for the next main trial on June 16, ordered that the court call the witnesses Milivoj Katnić, chief special prosecutor, Saša Čađenović, special prosecutor, Zoran Lazović and his son Petar, officials of the Police Administration and ANB, and Dejan Knežević, an officer of the Police Administration.
