The hearing for the control of the indictment that was scheduled for today in the High Court in Podgorica, in the "Plantation" case, has been postponed again.
Lawyer Bojana Franović and lawyer Marko Radović requested the disqualification of the President of the Supreme and Appellate Courts, as well as the President of the High Court, Boris Savić.
They indicated that they doubted their impartiality.
The hearing for the control of the indictment in this case has been postponed several times so far.
Franović stated that Savić cannot decide on this indictment because he participated in the decisions on the appeal against the decision of the investigating judge of the Podgorica High Court for this case.
She added that the detention decision was merely rewritten and pointed out its shortcomings.
She also requested that the President of the Court of Appeals not decide on this today's request for the exemption of Savić, pointing out the shortcomings that she believes he committed, which are also related to this case and the appeals for custody.
She added that the Acting President of the Supreme Court should be excluded from the decision for her request, because she is being investigated by the Agency for the Prevention of Corruption.
"I personally filed a report against her in another case to the Ministry of Justice in order to conduct a judicial investigation," added Franović.
The Special State Prosecutor's Office (SDT) previously filed an indictment against six former managers of the "Plantaže" company, who are charged with the criminal offense of abuse of position in business operations.
Included in the indictment are: Veselin Vukotić, Đorđije Rajković, Sead Šahman, Duško Perović, Božo Mihailović and Verica Maraš.
"They are accused that from December 24, 2019 to April 23, 2020 in Podgorica, as responsible persons in the damaged company 13. Jul-Plantaže AD, they abused their position in terms of disposing of other people's property and did not perform their duty, so they obtained from the business company "OMP-Engineering" DOO an illegal financial benefit exceeding the amount of forty thousand euros, and caused property damage to the injured party," said special prosecutor and SDT spokesman Vukas Radonjić earlier.
SDT states that as a result of the partial execution of an obviously harmful settlement, the company "OMP Engineering" received an illegal property benefit in the amount of 384.672,40 euros, and the injured company suffered damage.
For the criminal offense of abuse of position in business, which is the subject of the indictment, the law prescribes a prison sentence of two to ten years.
"The special police department, by order of the state prosecutor, and in accordance with the Law on Confiscation of Property Gains from Criminal Activity, undertakes measures and actions to detect and identify property gains from criminal activity, in order to eventually launch a financial investigation against the defendants," he stated earlier.
