After the Appellate Court of Montenegro revoked the acquittal, the High Court in Podgorica scheduled for July 21 the retrial of Budimir and Marina Krstović for smuggling 1.206 kilograms of cocaine, Marija Raković, the court's independent advisor for public relations, confirmed to "Vijesta".
Yesterday, the Court of Appeal overturned the acquittal of Budimir and Marina Krstović and sent the case back to the first instance court for a retrial.
The defense attorney of Marina Krstović, lawyer Stefan Jovanović, said earlier today that the defense did not receive the decision of the Appellate Court of Montenegro, but judging by the notification from the court's website, it is obvious that the panel of the Appellate Court, in terms of the factual situation, and according to the prosecution's appeal, did not find anything different from what was established by the first-instance acquittal, which leads the defense to the conclusion that the factual situation has been fully and accurately established, that is, that there is no evidence that would indicate the guilt of Budimir and Marina Krstović.
"It is also clear that in this particular case the reason for termination is reflected in an essential violation which essentially represents a technical issue, and which issue can be resolved immediately by the first-instance court in the retrial. In any case, and considering the entire evidence, and all the facts and circumstances of the case, the defense has no doubt that the innocence of Budimir Krstović and Marina Krstović will be proven indisputably," said Jovanović.
