The Basic State Prosecutor's Office in Podgorica will make a decision by the end of the week in the case against the general director of RTCG Boris Raonic, head of the legal department Želimir Mićović and RTCG lawyers Zorica Đukanović due to the suspicion that they allegedly incited the president and part of the members of the RTCG Council to commit a criminal offense to the non-execution of a final and enforceable court verdict, "Vijesti" has learned.
On June 22 of this year, ODT Podgorica interrogated Raonić, Mićović and lawyer Đukanović as suspects on the criminal complaint that they incited members of the RTCG Council to re-elect Boris Raonić as director of RTCG at the June 1 session, despite the final verdict of the High Court in Podgorica.
"By the end of the week, a decision will be made in the case, after which it will be known whether the indictment proposal will be submitted to the court", was told to "Vijesta" in the Podgorica ODT.
On June 1, despite the final court decision, the Council of RTCG decided to re-elect Boris Raonic as director of Radio and Television of Montenegro, the session was preceded by a preparatory meeting - on May 31, where, according to the Media Center's criminal complaint, legal steps were allegedly agreed upon in order to Raonic was re-elected.
According to the interpretation of the RTCG legal service, which was represented by the lawyer Želimir Mićović, which was also relied upon by some members of the RTCG Council, Raonic cannot be eliminated during the voting among the candidates registered in the 2021 competition.
Raonic proposed steps
Media center representative Goran Đurović, who filed a criminal complaint with the prosecutor's office on June 8, stated that Raonic was also present at the preparatory meeting.
"The presence of the former general director of RTCG Raonic at the preparatory meeting has no basis in the law or any internal, general act of RTCG, so it is justified to conclude that the purpose of his presence was to put pressure on the members of the RTCG Council and to encourage non-execution of the High Court's verdict. At the preparatory meeting, former General Director Raonic proposed the order of steps in solving the newly created situation, as well as the time of the Council session," says Đurović.
During the preparatory meeting held, as written in the Media Center's application, the representative of the legal service Želimir Mićović and the lawyer Zorica Đukanović challenged the High Court's verdict and suggested a solution that was in favor of Boris Raonic, which implied that Raonic should also be placed on the list of candidates for which the RTCG Council should declare at the official session of the RTCG Council scheduled for June 1, 2023
"From the statements in the media on May 31, 2023, as well as based on the course of the session and the performance of the head of the legal department Želimir Mićović and RTCG lawyer Zorica Đukanović, it can be unequivocally concluded that with their statements they deliberately influenced and incited the members of the RTCG Council to committing the criminal act of non-execution of a final and enforceable court verdict (Article 395 of the Criminal Code). Based on the decision of the RTCG Council 01-3576 from June 1, 2023, it can be concluded that the defendants Boris Raonić, Želimir Mićović and Zorica Đukanović succeeded in their plan to influence individual members of the RTCG Council and encourage them to commit a criminal offense because there were four candidates on the list of candidates for general director Nikola Markovic, Milutin Stijepović, Srdjan Covic, but also Boris Raonic, which is in direct opposition to the judgment of the High Court", Đurović points out.

In another case, the Special State Prosecutor's Office opened an investigation against public officials - the president of the RTCG Council Veselin Drljević and members Filip Lazović, Naod Zorić, Predrag Miranovića i Amine Murić due to the suspicion that they refused to execute a legally binding and enforceable court verdict and enabled the acquisition of illegal benefits to the elected general director of RTCG, Boris Raonić.
The case was assigned to the SDT by the prosecutor Vukas Radonjic, so invitations for questioning of suspected members of the RTCG Council are expected soon.
On May 10, the High Court in Podgorica confirmed the verdict of the Basic Court that the General Director of Radio and Television of Montenegro Boris Raonic was in a conflict of interest when he was elected to that position in August 2021 because he had already been appointed by the Assembly to another public position - member of the council of the Electronic Media Agency.
The court made a legally binding decision, and according to the claim of the candidate Nikola Marković, that according to the Law on the National Public Broadcaster, the fact that Raonic already holds a public office was a nuisance, so the legal consequence is - the annulment of the decision on the election of Raonic, a re-election among the registered candidates or the cancellation of the competition. .
In the judgment, among other things, it is written that the fact that Raonic resigned as a member of the Council of the Agency for Electronic Media "has no effect on the regularity of the application of substantive law".
The candidates for RTCG general director in 2021 were, apart from Raonic, Nikola Marković, Milutin Stijepović and Srđan Čović.
With the votes of four out of five members of the RTCG Council, Raonic was reappointed as general director. Member of the Council Marijana Camović Veličković she left the session before the vote, claiming that she did not want to participate in another illegal election. Member of the Council Milica Špajak at the beginning of the session, she pointed out that she would not vote if the Council accepted the proposal to decide on the candidates based on the 2021 competition.
Before the beginning of the session, he submitted his resignation from membership in the RTCG Council Bojan Baca.
