Attorney Damir Lekic he suggested yesterday that all the evidence collected by police officers accused of abuse in another case be excluded from the file of the brutal murder of Vidak Vujović.
He announced this in the Podgorica High Court at the hearing on the justification and legality of the indictment of the High State Prosecutor's Office against Dražena P. Vojvodića i News of G. Đikanović, who are accused of committing a crime on March 31, 2023, in Šteke, Podgorica.
Lekić is the defense attorney of the accused Vojvodić.
He explained that at the time of evidence collection on April 11, 2023, an indictment for abuse from 2022 had been filed against the police officers and that the court proceedings were ongoing.
He stated that a decision on their suspension and temporary removal from work should have been made earlier, reminding that the Minister of Police (Filip Adzic), after he pointed out this problem, issued a decision on suspension.
He added that he will not declare the guilt of Vojvodić until the court's decision on the exclusion of evidence from the case file is made.
"I am more than unpleasantly surprised by the content of the evidence on which this indictment is based. From the very beginning of this proceeding, I have testified that much of this evidence was collected illegally. What is important to point out is that at the earliest stage of this procedure evidence was collected by police officers who are not qualified to perform that job. I presented it to the prosecutor as well," stressed lawyer Lekić.
Then it's to the judges Boris Savić submitted the indictment that was brought against certain police officers who are suspected of torture. He added that he does not want to violate the presumption of innocence and go into whether those police officers are guilty, but he said that he thinks they should have been suspended much earlier.
"The police have come to a situation where criminals are discovering other criminals by conducting an investigation," lawyer Lekić pointed out and continued: "Illegalities do not end there and I point out that the rules were also broken when it comes to taking data from Dražen Vojvodić's phone. When we entered the room, the phone had already been removed from the evidence case. They didn't even ask him if it was his and if he wanted to give them the code. If they won't, then they should approach other methods. They have already started transferring data from the phone. When we asked how they got the code, they said from ANB", said the defense attorney of the accused Vojvodić.
Lawyer Aleksandra Rogošić, the defense attorney for the accused Đikanović, accepted the proposal of lawyer Lekić and stated that the indictment was unsustainable.
"I suggest that the criminal proceedings be suspended or that the indictment be returned to the prosecutor to prepare it," she stated.
And a lawyer Vidomir Bosković he suggested that the proceedings against Đikanović be suspended due to the lack of evidence that he committed a criminal offense.
The president of the extrajudicial panel, judge Boris Savić, said that the court will make a decision within the legal term.
The indictment states that on March 31, in Šteke, Podgorica, the defendants killed Vujović in an insidious and ferocious manner, after luring him to an inaccessible place.
"So that the defendant Vojvodić Dražen, using their acquaintance from before, drove him to the scene in a 'golf V' vehicle, and when the victim got out of the vehicle, in the same direction, he fired at least four projectiles from a 'CZ M57' pistol, from of which he was hit by four missiles. And because between the four projectiles fired, the injured Vujović Vidak was alive and told the defendant: 'Don't', during which time he suffered severe suffering and severe pain, which the defendant Vojvodić did not do, but continued to fire missiles at the injured party. During that time, the defendant Đikanović Novica was on the spot and observed everything, after which the defendant Vojvodić fired a projectile that caused fatal injuries to the victim, resulting in his death. "After that, together with the defendant Đikanović, he poured gasoline and set fire to the lifeless body of the injured Vidak Vujović, and then they left the scene together," the indictment reads.
It is stated that Đikanović, in his family home in Farmaci, Podgorica, kept seven pieces of pistol ammunition without the approval of the competent authority.
